ORDINANCE NO..89-1-4173
AN ORDINANCE AMENDING ORDINANCE NO. 88-10-4835
WHEREAS, on October 11, 1988, the Board of Com-
missioners adopted Ordinance No. 88-10-4135 which declared a
90 day moratorium on demolition of any structure located in
an H-1, H-2, B-2 or B -2T Zone or the demolition of any
buildings, any portions of which were constructed prior to
1940, at any location within the City of;Paducah; and
WHEREAS, this ordinance was amended by Ordinance
No. 88-10-4146 on October 25, 1988; and
WHEREAS, the Board of Commissioners wishes to
extend this moratorium for an additional sixty days.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Ordinance No. 88-10-4135 is
hereby amended to read as follows:
A. A 99 150 day moratorium is declared on the
demolition of any structures located in an H-1, H-2, B-2 or
B -2T Zone, or the demolition of any buildings, any portions
of which were constructed prior to 1940, at any location
within the City of Paducah.
B. All permits for demolition of buildings as
set out in Section 1 above are hereby suspended for a period
of 99 150 days unless the permit holder is in the active
process of demolition. The Building Inspector shall notify
any holder of a demolition permit issued prior to October
11, 1988, who is not in the active process of demolition on
October 11, 1988, that the demolition permit is suspended
for a period of 99 150 days.
C. The Board of Commissioners may grant excep-
tions to the above enacted 98 150 day moratorium by enacting
a Municipal Order granting permission for the demolition of
a structure if one or more of the following conditions are
found to exist:
1. A structure has deteriorated to such an
extent that stabilization of the structure is

not likely to cure the potentially dangerous
condition of the building, and the recommen-
dation of the Fire Marshal is to demolish the
structure in order to protect the life and
safety of the public; OR
2. An economic hardship exists on the property
owner AND the owner has filed with the Board
of Commissioners a developmental plan showing
that the demolition of the building is
necessary for the development of the owner's
plans for improvements within the City and
that the demolition is an integral part of
these plans, AND that a 90 150 day delay will
act as an economic disadvantage to the
developer, AND that the buildings proposed to
be demolished are not historically signifi-
cant to the City of Paducah.
SECTION 2. This moratorium shall expire on March
