HomeMy WebLinkAbout87-12-3098226 --�LLLL—__ ORDINANCE NO. 87-12-3098 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED IN TRACT NUMBER ONE OF THREE OAKS PARK SUBDIVISION, WEST OF FRIEDMAN LANE, AND AMENDING THE PADUCAH ZONING ORDINANCE -1976 SO AS TO EFFECT SUCH RE- ZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on December 7, 1987, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED RE- ZONING OF PROPERTY LOCATED IN TRACT NUMBER ONE OF THE THREE OAKS PARK SUBDIVISION, WEST OF FRIEDMAN LANE", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amendment proposed in said resolution be, and the same are hereby, de- clared to be in agreement with the comprehensive plan of the City of Paducah. (� SECTION 3. That the zone classification of the following property be, and it is hereby, changed from R-4, High Density Residen- tial Zone, restricted to professional office buildings, to R-4, High Density Residential Zone, restricted to professional office buildings and retirement centers: Beginning at a steel rod set where the northeasterly line of the herein described property intersects the northwesterly right-of-way line of Ramona Drive, said point being the southern most corner of the Louise Beaton property ag shown by plat of record in the County Court Clerk's Office, said rod also being located 199.96 feet northwest of a concrete monument located at the northwest corner of a lot owned by or formerly owned by William 0. Walker as stated by deed of record in the County Court Clerk's office, said steel rod also being located at the beginning of a curve concave to the southeast and having a radius length of 250 feet and a chord length of 150.35 feet; thence along the arc of said curve in a southwesterly direction, a distance of 50 feet to a steel rod located at the southwesterly end of the currently dedicated right-of-way of Ramona Drive and then continuing l along the aforesaid arc of said curve a distance of 102.72 feet, for a total length of 152.72 feet to a steel rod set at the end of said curve; thence in a southerly direction a distance of 122.98 feet to a steel rod set at the beginning of another curve concave to the northwest, said curve having a radius length of 200 feet and a chord length of 116.92 feet; thence in a southerly and southwesterly direction along the arc of said curve, 118.65 feet to a steel rod at the end of said curve; thence in a southerly direction a distance of 357.55 feet to a steel rod set at the southern most corner of the herein described tract; thence in a northwesterly direction a distance of 400 feet to a steel rod; thence in a northeasterly direction a distance of 724.81 feet to a concrete monument located at the westerly most corner of the Louise Beaton property; thence in a southeast direction along and with the southwesterly line of said Beaton property, a distance of 254.10 feet to the point of beginning. SECTION 4.. That this zone change amendment is conditioned upon the following: 1. The only R-4 use permitted shall be professional office buildings and retirement centers. All other uses shall be restricted to those allowed in an R-2 Zone. - 2. Substantial construction must be started prior to December, 1989, or the Commission will hold a public hearing to determine if the zoning amendment should revert to R-2, Low/Medium Density Residential Zone. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs, and provisions. SECTION 6. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified summary thereof.
