AN ORDINANCE AMENDING SECTION 12-46, QUALIFICATIONS OF
TRAINEES, OF CHAPTER 12, FIRE -PREVENTION AND PROTECTION, AND SECTION
2 -30, --COMPULSORY RETIREMENT AT AGE SEVENTY; EXCEPTIONS, OF CHAPTER 2,
ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY
WHEREAS, it is the intent of:the Board of Commissioners to
allow employment with the City -of Paducah in compliance with state and
federal law; and.
WHEREAS, Federal Law prohibits any mandatory age except for
members of Police and Fire Departments.
BE IT ORDAINED BY THE.CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Section 12-46, Qualifications of trainees,
is amended to read as follows:- _.
"No person shall`b'e employed -as an applicant -candidate for
employment as a fireman in the fire department who does not possess the
following qualifications and comply with the following requirements:
"(1) He They must be able to read, write and understand the
English language and must be a high school graduate or
hold a certificate of high school equivalence issued on
the basis of a successful completion of the General
Educational Development Test administered and approved
under the supervision of the United States Armed Forces
Institute, or a recognized institute of higher
learning, or the Commonwealth of Kentucky.
"(2) He They must be at least eweeey-erre-{-2-1} eighteen (18)
years of age and must not have reached kis their
thirty-eighth (38th) birthday.
"(3) He They must be a-�ee�ed-eee-a€-P4e6eeea-6er:ey,
Keneeeky;-and a maeep rson of sobriety and integrity

who at all times has been an orderly law-abiding
citizen."
SECTION 2. Section 2-30, Compulsory retirement at age
seventy; exceptions, is hereby amended to read as follows:
"(a) Each employee of the city of Paducah police department
and fire department, upon reaching seveney-{49}
sixty-five (65) years of age, shall be required to
immediately retire from such employment. Nothing in
this section shall be construed to compel any member of
rte'" the police department or fire department who has
reached (60) years of age on or before January 1, 1988,
and who is able to perform his assigned duties, to
retire prior to reaching seventy (70) years of age.
"(b) Nothing in this section shall be construed to compel
any member of the police department or fire department,
able to perform his assigned duties, to retire before
completing at least twenty (20) years of such
employment as provided for by Section 95.858 of the
Kentucky Revised Statutes -.11

SECTION 3. This ordinance shall be read on two separate days
and will become effective .upon publication of title and a certified
summary thereof.
