HomeMy WebLinkAbout87-10-3075.H ,. m aM­.,, ­..,-- _.� .:, d, L1raJs�ytHl.k_L—L�Il.,.. r....�-.,.� dwd�l.msmM::.e�f�ellILIr6�IwImIeWIIIUud6u,L�N�.�,6d1�,__ • M ORDINANCE NO. 87-10-3075 AN ORDINANCE WAIVING THE CITY OF PADUCAH'S APPROVAL OF % IMPROVEMENTS TO THE EXECUTIVE INN WHEREAS, the City of Paducah and MRJ&B Corporation entered 1 1 i into a Lease Agreement on the 1st day of August, 1980; and WHEREAS, said Lease Agreement was most recently assigned to Smith Development, Inc.; and WHEREAS, Smith Development, Inc. plans extensive remodeling of the hotel complex; and WHEREAS,.the Board of Commissioners has determined that Smith Development, Inc:. is best suited for determining the need and extent of necessary renovations; and WHEREAS, Section 4 of.the Lease requires approval by the City before any alterations can be made; and WHEREAS, it is the intent of the City to waive the require- ment of the City's pre -approval -as above set forth. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of -Paducah hereby waives any and all obligations of Smith Development, Inc. to submit plans to the City of Paducah, as required by Section 4, "Construction of Improvements", of a certain Lease entered into on the 1st --.day of August, 1980, by and between the City of Paducah and MRJ&B Corporation, which has been most recently assigned to Smith Development, Inc. SECTION 2. The waivers set out in this ordinance go only to the Lease specifically mentioned herein, and this ordinance does not constitute a waiver of any rights required by the Lease for the Convention Center portion of the project. SECTION 3. It is the intent of the City only to waive the approvals required by Section 4 of the above-mentioned Lease, and it is not the intent of the City, nor is there any waiver, of any requirement for submission to appropriate governmental agencies, whether city or state, dealing with construction standards, building safety, etc. SECTION 4. In order to expedite the necessary waivers so that the renovations to the hotel complex can be made, an emergency is hereby declared to exist, and this.ordinance shall be effective upon one reading and publication of a certified summary thereof.
