ORDINANCE NO. 87-8-3056
AN ORDINANCE EXEMPTING H. B. FULLER COMPANY FROM THE PAYMENT
OF CERTAIN CITY TAXES FOR A PERIOD OF FIVE YEARS
WHEREAS, it is provided by Section 92.300(1) that the
legislative body of any city of the second to sixth class may, by
ordinance, exempt manufacturing establishments fromcity taxation for a
period not exceeding five years as an inducement to their location in
the city; and
WHEREAS, H. B. Fuller Company has requested such exemption
for the purpose of establishing a manufacturing.establishment in the
City of Paducah, Kentucky; and
WHEREAS, the Board of Commissioners of the City of Paducah,
Kentucky, finds"that the granting of such an exemption will induce
H. B. FULLER to locate a new manufacturing establishment in the City of
Paducah, and that the benefits to said City and its citizens of the
location of such new manufacturing establishment in said City will
greatly exceed any benefits derived from such taxes if such an
exemption were not granted; and
WHEREAS, the Board of Commissioners of the City of Paducah,
Kentucky, desires to grant such exemption as an inducement for said
manufacturing establishment to be located in the city.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the real estate to be purchased by H. B.
Fuller Company for a manufacturing site, together with all of its
associated manufacturing equipment subject to city taxation, be
exempted from such city ad valorem taxation as provided for by Section
92.300(1) for a period of five years, beginning with the first half
(payable in the fall, 1988) of the taxes assessed as of January 1,
1988, for the fiscal year 1988-89, as an inducement for said
is as follows:
Sixty-one.(61) acres, more or less, located on the
Coleman Road and contained within the Coleman Road
Industrial.Site, and as to be conveyed from Genex
Corporation to H. B. Fuller Company.
establishment to be located within the corporation limits of
the
City
of Paducah, Kentucky. A brief description of the aforesaid
real
estate
is as follows:
Sixty-one.(61) acres, more or less, located on the
Coleman Road and contained within the Coleman Road
Industrial.Site, and as to be conveyed from Genex
Corporation to H. B. Fuller Company.

SECTION 2. In addition to the.tax..relief granted to H. B.
Fuller Company in Section 1 above, the City of Paducah extends the
following tax incentives to H. B. Fuller Company .and its employees:
A. A fifty percent (50%) reduction in the refuse collection
fees as set forth in Section 27-49 of the Code
Ordinances, for a .period. .of five (5) years, starting
January 1, 1988.
B. A five (5) year moratorium on business license fee,
starting January 1, L988, on any licenses required by
Chapter 17 of the Code of Ordinances of the City of
Paducah.
C. For a period of five (5) years, starting September 1,
1987, no building or electrical plan review and/or
building or electrical permit fees shall be charged to
H. B. Fuller Company. This provision does not waive the
necessity of .obtaining all necessary permits.and
licenses and meeting all requirements of the applicable
Building and Electrical Codes.
D. License fee on employees under Section 17-127, etc., of
the Code of Ordinances of the City of Paducah, shall be
reduced by fifty percent (50%) for a period of two (2)
years, starting January 1, 1988.
SECTION 3. If at any time said H. B. Fuller Company should
cease operating said manufacturing establishment, except periods of
non -manufacturing activities caused by accidents, mishaps, breakdowns,
strikes or other unavoidable occurrences or casualties, the exemption
granted herein shall be immediately cancelled and held for naught.
SECTION 4. If any provision of this ordinance is found by a
court of competent jurisdiction to be invalid or unconstitutional, or
if the application of this ordinance to any person or circumstance is
found to be invalid or unconstitutional, such invalidity or unconstitu-
tionality shall not affect the other provisions or applications of this
ordinance, which can be given effect without the invalid or unconstitu-
tional provision or application.
SECTION 5. This ordinance shall be read on two separate days
and will be effective upon publication of title and a certified summary
thereof.
