ORDINANCE NO 8.7-4-2984
AN ORDINANCE CREATING SECTION 7-7.5, EXISTING STRUCTURES
CODE, OF CHAPTER 7, BUILDINGS AND BUILDING REGULATIONS OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH
WHEREAS, Chapter 16, Housing Codeof the Code of Ordinances
of the City of Paducah, is being replaced by the adoption of "The BOCAl
National Existing Structures Code, Second Edition, 1987", as published
by the Building Officials and Code Administrators International, Inc.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. Section 7-7.5, Existing Structures Code, is
hereby adopted as follows:
"That a certain document, one copy of which is on file in the
Office of the City Clerk of the City of Paducah, being marked and
designated as 'The BOCA National Existing Structures Code, Second
Edition, 1987', as published by the Building Officials and Code
Administrators International, Inc., is hereby adopted as the existing
Structure Code of the City of Paducah, in the State of Kentucky; for
the control of buildings and structures as herein provided; and each

and all the regulations, provisions, penalties, conditions and terms of
said BOCA National Existing Structures Code are hereby referred to,
adopted, and made a part here, as if fully set out in this ordinance,
with the additions, insertions, deletions, and changes, if any,
prescribed in Section 2 of this ordinance."
SECTION 2. Section 7-7.6, Revisions of Existing Structure
Code, is hereby adopted as follows:
"That the following sections of the BOCA National Existing
Structures Code are hereby revised as follows:
"(a) Sec. ES -100.1 (page 1, second line), insert 'City of
Paducah, Kentucky'.
"(b) Sec. ES -110.2 (page 8, third line), should be changed to
read 'not less than Ten Dollars ($10.00) nor more than
Five Hundred Dollars ($500.00)'. 1)
"(c) Sec. ES -110.2 (page 8, fourth line), change to read,
'not to exceed thirty (30) days'.
"(d) Sec. ES -112.4 (page 9, second line), change to read,
'thirty (30) days after service'.
"(e) The term 'building official', as used in the BOCA
National Existing Structures Code, shall be deemed to be
the Fire Marshal of the City of Paducah.

"(f) The 'Code Appeals Board' referred to in the BOCA
National Existing Structures Code shall be the Building
Code Appeals Board of the City of Paducah, as set forth
in Section 7-20 of the Code of Ordinances."
SECTION 3. Section 7-7.7, Conflicts, is hereby adopted as
follows:
"If any conflicts exist between the BOCA National Existing
Structures Code and the Kentucky Building Code, the Kentucky Building
Code shall take precedent and control over all such matters."
SECTION 4. That nothing in this ordinance or in the existing
Structures Code hereby adopted shall be construed to affect any suit or
proceeding impending in any court, or any rights acquired, or any
liability incurred, or any cause or cause of action accrued or
existing, under any act or ordinance hereby repealed, as cited in
Section 5 -of this ordinance; nor shall any just or legal right or
remedy of any character be lost, impaired or affected by this
ordinance.
SECTION 5. The following sections of the Code of Ordinances
of the City of Paducah are hereby repealed in their entirety: Section
7-8, Unsafe Buildings and Structures; and Chapter 16, Housing Code, in

its entirety.
SECTION 6. This ordinance shall be read on two separate days
and will become effective upon publication of title and a certified
summary thereof.
