HomeMy WebLinkAbout87-4-299754 \V ORDINANCE NO. 87-4-2997 AN ORDINANCE AMENDING SECTIONS 21-1, 21-3, 21-7, 21-10, 21-11, 21-12, 21-14 and 21-15 OF CHAPTER 21, NOISE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 21-1, Loud, disturbing and unnecessary noise generally, of the Code of Ordinances of the City of Paducah is hereby amended as follows: "The creating of any unreasonably loud, disturbing and unnecessary noise within the corporate limits of the city is prohibited. Any noise of such character, intensity or duration as to be detrimental to the-llie-eeup blic health, a -eat-}a� dtza�;-ems-tea d4atttrbanee-ei-the-ptt$l-icpeace and welfare, is prohibited." SECTION 2. That Section 21-3, Yelling, shouting, etc., on Streets, of the Code of Ordinances of the City of Paducah, is hereby amended as follows: _ "Yelling, shouting, hooting, whistling or singing en -the �1 publie-streete, particularly between the hours of 11:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb the quiet, comfort or repose of any persons in any hospital, dwelling, hotel or any other type of residence or of any persons in the vicinity, is hereby prohibited." SECTION 3. That Section 21-7, Building and excavating operations, of the Code of Ordinances of the City of Paducah, is hereby amended as follows: "The erection (including excavation), demolition, alteration or repair of any building in any residential district or section, and the excavation of streets and highways in any residential district or section, other than between the hours of 7:00 a.m. and 6:00 p.m. on weekdays, is hereby prohibited, except in case of urgent necessity in the interest of public health and safety and then only with a permit from the mailer building inspector, which permit may be granted for, a period not to exceed thirty (30 days while the emergency continues. If the may" building inspector.should determine that the public health and safety will not be impaired by the erection demolition, alteration 55 or repair of any building or the excavation of streets and highways within the hours of 6:00 p.m. and 7:00 a.m., and if he shall further determine that loss or inconvenience would result to any party in interest, he may grant permission for such work to be done within the hours of 6:00 p.m. and 7:00 a.m. upon application being made at the time the permit for the work is awarded or during progress of the work. " SECTION 4. That Section. 21-10, Noisy vehicles'generally, of the Code of Ordinances of the City of Paducah, is hereby amended as follows: "The creation of a loud, and excessive and unnecessary noise in connection with the loading or unloading of any vehicle or the. opening and destruction of bales, boxes, crates and containers, is hereby prohibited." SECTION 5. That Section 21-11, Sounding of vehicle horn or signal, of the Code of Ordinances of the City of Paducah, is hereby amended as follows: "The sounding of any horn.or signal device on any automobile, motorcycle, bus, or other vehicle, except as a danger signal,-enehe-e}eke-s-e�geeesg;-g��aea�-eek-e€ eese�;-e-€-s-ffieerz;-e�Zearse-thea-es-e-�aeaag-sgse�-eat; or the creation by means of any such signal device of any unreasonably loud or harsh sounds, and the sounding of such device for an unnecessary and unreasonable period of time, is hereby prohibited." SECTION 6. That Section 21-12, Use of loudspeakers, amplifiers, etc., on vehicles for commercial advertising, of the Code of Ordinance of the City of Paducah, is hereby amended as follows: "The use of mechanical loudspeakers, amplifiers, bands, orchestras or musical instruments on trucks or other motor vehicles €er ee�ateee�-e�esag is hereby prohibited; provided, however, the use l' of such loudspeakers, musical instruments or other devices enumerated herein shall not abe unlawful if there has been issued to the person using the same a permit signed by the mayor." SECTION 6. SECTION 7. That Section 21-15, Penalty for violations of . chapter, of the Code of Ordinances of the City of Paducah, is hereby amended as follows: "Any person who shall violate any provisions of this chapter shall be guilty of a mi9detaese.er violation and, upon conviction thereof, shall be fined net-}ess-thea-eae-de}}e�_{};A9}-e-mese-ars f}frey-de}}er9-{$59:99} not more than two hundred fifty dollars for each offense, and each.day that such violation continues shall constitute a separate offense." SECTION 8. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof.
