ORDINANCE NO. 94-7-5167
AN ORDINANCE ORDERING AN ELECTION BY THE QUALIFIED
VOTERS OF THE CITY OF PADUCAH, KENTUCKY, TO BE HELD ON THE
REGULAR ELECTION DAY, NOVEMBER 8, 1994, IN THE CITY OF PADUCAH,
KENTUCKY, TO DETERMINE THE QUESTIONS WHETHER PADUCAH POWER
SYSTEM SHALL ACQUIRE BY THE EXERCISE OF THE POWER OF EMINENT
DOMAIN THE ELECTRIC FACILITIES OF JACKSON PURCHASE ELECTRIC
COOPERATIVE CORPORATION LOCATED WITHIN THE CITY LIMITS OF
PADUCAH, KENTUCKY, AND WHETHER PADUCAH POWER SYSTEM SHALL ISSUE
REVENUE BONDS TO PAY FOR THE ACQUISITION
WHEREAS, the Mayor and Board of Commissioners of the
City of Paducah, Kentucky, declare that it is desirable that
all persons, businesses and other entities within the municipal
boundaries of the City of Paducah, Kentucky, purchase and
receive their electric power from the City's municipal power
company, the Electric Plant Board of the City of Paducah,
Kentucky, d/b/a Paducah Power System; and
WHEREAS, certain areas within the city limits of the
City of Paducah, Kentucky, are presently being served by
another electric company, the Jackson Purchase Electric
Cooperative Corporation; and
WHEREAS, the areas within the city limits of the City
of Paducah, Kentucky, presently being served by Jackson
Purchase Electric Cooperative Corporation are depicted as the
shaded areas on the map of the City of Paducah, Kentucky,
attached hereto and incorporated herein; and
WHEREAS, the Mayor and Board of Commissioners of the
City of Paducah, Kentucky, declare that it is desirable that
Paducah Power System acquire by condemnation the electric plant
and facilities of Jackson Purchase Electric Cooperative
Corporation lying within the city limits of Paducah, Kentucky,
which electric plant and facilities lie within the shaded
portions of the map attached hereto; and
WHEREAS, the qualified voters of the City of Paducah
should be given the opportunity at the next regular November
election to decide whether or not Paducah Power System shall
acquire by condemnation the electric plant and facilities of
Jackson Purchase Electric Cooperative Corporation lying within
the municipal boundaries of the City of Paducah, Kentucky, and
whether or not revenue bonds in an amount sufficient to pay the
entire damages and costs of such acquisition should be issues
p by Paducah Power System.
"w BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Board of Commissioners of the City of
Paducah hereby declares its desire that the Electric Plant
Board of the City of Paducah, d/b/a Paducah Power System,
acquire by condemnation the electric plant and facilities of
Jackson Purchase Electric Cooperative Corporation lying within
the municipal boundaries of the City of Paducah, Kentucky.
SECTION 2. The property to be condemned shall be the
electric plant, as defined in KRS 96.550(5),
of Jackson
Purchase Electric Cooperative Corporation lying within the
present city limits of Paducah, Kentucky, and within those
shaded areas as shown on the attached map of the City of
Paducah, Kentucky, including all tangible or intangible
property, franchises, easements and rights, located therein or
pertaining thereto, which in the judgment of the Paducah ower
System are necessary or convenient. '
SECTION 3. Pursuant to the provisions of KRS 96.550
to 96.900 there shall be submitted to the qualified voters of
the City of Paducah at the next regular November election on
November 8, 1994, the following question: "Are you in favor of
the Paducah Power System, the Electric Plant Board of the City
of Paducah, Kentucky, acquiring by the exercise of the power of
eminent domain the electric plant and facilities located in all
areas of the city that are not presently being served by Paducah
Power System, and the issuance of revenue bonds in an amount
sufficient to pay the entire damages and costs of such
acquisition?"
SECTION 4. The Mayor, acting by and through the City
Clerk, shall certify this Ordinance to the Clerk of the
McCracken County Court, who shall have printed on the official
ballots for use in the regular election in the City of Paducah,
Kentucky, on November 8, 1994, the following question:
Are you in favor of the Paducah Power System, the
Electric Plant Board of the City of Paducah,
Kentucky, acquiring by the exercise of the power
of eminent domain the electric plant and
facilities located in all areas of the city that
are not presently being served by Paducah Power
System, and the issuance of revenue bonds by
Paducah Power System in an amount sufficient to
pay the entire damages and costs of such
acquisition?

SECTION 5. Pursuant to KRS 96.640, the Mayor of the
City of Paducah shall advertise such election and the object
thereof by publication pursuant to KRS Chapter 424 and also by
printed handbills posted in not less than four (4) conspicuous
places in each voting precinct in the municipality and at the
courthouse door, and by such other means as she may consider
desirable or necessary. All qualified voters of the City of
Paducah shall have the privilege of voting at said election.
SECTION 6. This ordinance shall be read on two
separate days and will become effective upon summary publica-
tion pursuant to KRS Chapter 424.
