AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION
OF PROPERTY OF NOONAN DEVELOPMENT CORPORATION FOR WEST PARK
VILLAGE TOWNHOMES, LOCATED ON WEST PARK DRIVE AND WEST TOWN
DRIVE, ACCEPTING THE DEDICATION OF PUBLIC EASEMENTS AND SETTING
P BOND AMOUNT
�y WHEREAS, the Paducah Planning Commission, at a
meeting held on June 13, 1994, adopted as a preliminary report
a plat of the proposed subdivision of property of Noonan
Development Corporation for West Park Village Townhomes, and by
Resolution dated June 13, 1994, recommended to the Board of
Commissioners of the City of Paducah, Kentucky, the adoption of
an ordinance approving the final plat of said subdivision re-
flected thereon, and accepting the dedication of the public
easements shown thereon; and
WHEREAS, the City Engineer has recommended a letter
of credit in lieu of a bond, adopted by Municipal Order No.
in the amount of $160,181.00, for construction of streets,
storm drainage systems, sanitary sewers, water lines,
monuments, and other designated public improvements.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah
�G Planning Commission on June 13, 1994, entitled, "A RESOLUTION
CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMIS-
SION ON THE PROPOSED SUBDIVISION OF PROPERTY OF NOONAN
DEVELOPMENT CORPORATION FOR WEST PARK VILLAGE TOWNHOMES LOCATED
ON WEST PARK DRIVE AND WEST TOWN DRIVE", be approved as the
final report of said Commission respecting the matters set
forth therein.
SECTION 2. That the subdivision of said property
shall be, and it is hereby, approved as shown on the plat
referred to in said subdivision, which plat is entitled, "West
Park Village Subdivision", and said property is hereby declared
to be subdivided as shown on said plat.
SECTION 3. That the dedication of the public rights-
of-way and public utility easements shown on said plat shall
be, and they are hereby, accepted, but such acceptance shall
not constitute an undertaking on the part of this Board or the

City of Paducah, Kentucky, for the construction, improving or
maintaining of said right-of-way, that being a matter for
separate consideration and action. The Mayor is hereby
authorized to subscribe a certificate of approval on the plat.
SECTION 4. That a letter of credit in lieu of a
bond, adopted by Municipal Order No. 6?? in the amount of
$160,181.00, is set and that said escrow agreement shall be in
such form and containing such contents that meet the approval

of the City Engineer and the Corporation Counsel of the City of
Paducah.
SECTION 5. That if any section, paragraph or provi-
sion of this ordinance shall be found to be inoperative, inef-
fective or invalid for any cause, the deficiency or invalidity
of such section, paragraph or provision shall not affect any
other section, paragraph or provision hereof, it being the
purpose and intent of this ordinance to make each and every
section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
SECTION 6. Due to a delay in approval resulting from
the lack of a quorum of the Planning Commission, an emergency
is hereby declared to exist and this ordinance shall become
effective immediately with one reading.
