ORDINANCE NO. 933
AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION
OF PROPERTY OF KEILER AND MAY PROPERTIES LOCATED IN PINES
SUBDIVISION -SECTION III, LOCATED WEST OF DEER PATH LANE, WEST
OF WHITNEY DRIVE, AND EAST OF I-24, ACCEPTING THE DEDICATION OF
PUBLIC RIGHTS-OF-WAY AND EASEMENTS AND ACCEPTING A LETTER OF
CREDIT
WHEREAS, the Paducah Planning Commission, at a
meeting held on February 1, 1993, adopted as a preliminary
report a plat of the proposed subdivision of property of Keiler
and May Properties located in Pines Subdivision -Section III,
and by Resolution dated April 5, 1993, recommended to the Board
of Commissioners of the City of Paducah, Kentucky, the adoption
of an ordinance approving the final plat of said subdivision
reflected thereon, and accepting the dedication of the public
rights-of-way and easements shown thereon; and
WHEREAS, the City Engineer has recommended a
letter of credit in lieu of a bond adopted by Municipal Order
No. G75 in the amount of $18,550.00 for construction of
streets, storm drainage systems, sanitary sewers, water lines,
' monuments, and other designated public improvements.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah
Planning Commission on April 5, 1993, entitled, "A RESOLUTION
CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF KEILER
AND MAY PROPERTIES LOCATED IN PINES SUBDIVISION -SECTION III",
said property being located west of Deer Path Lane, west of
Whitney Drive and east of I-24, be approved as the final report
of said Commission respecting the matters set forth therein.
SECTION 2. That the subdivision of said property
shall be, and it is hereby, approved as shown on the plat
referred to in said subdivision, which plat is entitled,
"The Pines Subdivision -Section III", and said property is
hereby declared to be subdivided as shown on said plat.
SECTION 3. That the dedication of the public
rights-of-way and public utility easements shown on said plat
shall be, and they are hereby, accepted, but such acceptance
shall not constitute an undertaking on the part of this Board
or the City of Paducah, Kentucky, for the construction,
improving or maintaining of said right-of-way, that being a
matter for separate consideration and action. The Mayor is
hereby authorized to subscribe a certificate of approval on the
plat.
SECTION 4. That a letter of credit in lieu of a bond
adopted by Municipal Order No. (o*7S" in the amount of
$18,550.00, is set and that said letter of credit in lieu of a
bond shall be in such form and containing such contents that
meet the approval of the City Engineer and the Corporation
Counsel of the City of Paducah.
SECTION 5. That if any section, paragraph or
provision of this ordinance shall be found to be inoperative, �!
ineffective or invalid for any cause, the deficiency or
invalidity of such section, paragraph or provision shall not
affect any other section, paragraph or provision hereof, it
being the purpose and intent of this ordinance to make each and
every section, paragraph and provision hereof separable from
all other sections, paragraphs and provisions.
SECTION 6. This ordinance shall be read on two
separate days and will become effective upon summary
publication pursuant to KRS Chapter 424.
