AN ORDINANCE DEEMING IT NECESSARY TO CONDEMN AND
ACQUIRE FOR PUBLIC PURPOSES CERTAIN REAL ESTATE LOCATED IN
McCRACKEN COUNTY, KENTUCKY, FOR FURTHER AVIATION DEVELOPMENT OF
BARKLEY REGIONAL AIRPORT
WHEREAS, pursuant to the authority granted to a city
of the second class by the Kentucky Constitution, Section 242,
and Kentucky Revised Statutes 82.082 and 183.476, the City of
Paducah, Kentucky, a city of the second class, together and in
conjunction with the County of McCracken, Kentucky, a political
subdivision of said state, both of whom are the joint owners of
a public airport located in McCracken County, Kentucky, known
as Barkley Regional Airport, do hereby deem it necessary to
condemn and acquire for public purposes certain real estate
located in McCracken County, Kentucky, for further aviation
development; and
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That in order to conform with the
regulations of the Federal Aviation Administration, relative to
navigation facilities and the safe maintenance of approaches to
Barkley Regional Airport, the City of Paducah, in conjunction
with McCracken County, hereby authorizes the condemnation a
tract of real estate located in McCracken County, Kentucky.
v SECTION 2. That the corporation counsel of the City
of Paducah, Kentucky be, and is hereby authorized and directed
to institute condemnation proceedings in the McCracken Circuit
Court in the name of the City of Paducah, Kentucky, against 0.
T. Allen and Martha Sue Allen, his wife, of the herein -
described real property for the purpose of further aviation
development of Barkley Regional Airport.
SECTION 3. The condemnation sought to be acquired is
located in McCracken County, Kentucky, and is more particularly
described as follows:
Beginning at a railroad spike in the north line of
U.S. Highway 60 near its intersection with the east
line of the Fisher Road; thence with the north U.S.
Highway 60 N 79 degrees 14 minutes 21 seconds W
1,395.03 feet to an existing iron rod corner to
Quarles; thence in a northerly direction with the
Allen -Quarles line N 00 degrees 18 minutes 44 seconds
E 253.27 feet to a point in the southerly side of Old
Cairo Road (Ky. Highway 305); thence N 74 degrees 56
minutes 49 seconds E 1,557.56 feet to the point of
intersection of the southerly line of Old Cairo Road
and the west line of Fisher Road; thence with the
west line of Fisher Road S 20 degrees 56 minutes 15
seconds W 935.87 feet to a railroad spike in the
beginning of a curve to the left, thence along with a
chord line S 60 degrees 55 minutes 57 seconds W 25.66
feet to another railroad spike, the point of begin-
ning. Containing 22.0053 acres as shown by the
Florence and Hutcheson, Inc. survey by Jeffrey K.

Clark PLS #3117 dated July, 1993. There is excepted
apart from the above described 22.0053 acres the fee
simple title of the City of Paducah, Kentucky,and the
County of McCracken, Kentucky, to certain airspace,
together with the right of ingress and egress for the
purpose to cut, trim and remove vegetation and other
obstructions which protrude into the airspace over
the portion described in the Deed of Conveyance from
the Special Commissioner to the City of Paducah,
Kentucky, and the County of McCracken, Kentucky,
dated September 18, 1973, and recorded in Deed Book
556, page 252, McCracken County Clerk's Office.J
Being in all respects the same real estate conveyed
to O. T. Allen and Martha Sue Allen, his wife, by
deed dated November 16, 1954, and recorded in Deed
Book 355, page 422, in the McCracken County Clerk's
Office.
SECTION 4. This ordinance shall be read on two
separate days and will become effective upon summary publi-
cation pursuant to KRS Chapter 424.
