ORDINANCE NO. 93 -12 -SOS ;2'
AN ORDINANCE CLOSING A PORTION OF 25TH STREET BETWEEN
WASHINGTON STREET AND KENTUCKY AVENUE
WHEREAS, Western Baptist Hospital has requested that a
portion of 25th Street between Washington Street and Kentucky
Avenue be closed; and
WHEREAS, the Planning Commission approved these closings
on December 6, 1993.
THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That the City of Paducah does hereby
authorize the closing of a portion of 25th Street between
Washington Street and Kentucky Avenue which is more particularly
described as follows:
Beginning at a point, said point being located North 62
45' 38" East a distance of 860.12 feet from the
intersection of the south right-of-way line of Kentucky
Avenue and the east right-of-way line of 27th Street;
thence from said point of beginning along the south
right-of-way line of Kentucky Avenue, North 62 45' 38"
East a distance of 60.00 feet to a point; thence, along
the east right-of-way line of 25th Street, South 27 15'
41" East a distance of 346.30 feet to the north right-of-
way line of Washington Street; thence, along the north
right-of-way line of Washington Street, South 62 45' 43"
West a distance of 60.00 feet to a point; thence, along
the west right -of way line of 25th Street, North 27 15'
41" West a distance of 346.29 feet to the point of
beginning, and containing 0.477 acres.
SECTION 2. The City is approving the closing of the
right-of-way contingent upon the City maintaining any and all
existing utility easements thereon, over and under the right-of-way
being closed, until as such times as the utilities are relocated
and new easements are dedicated to the City. At which time the
previous easements will be deeded to the appropriate property
owners.
SECTION 3. The Corporation Counsel of the City Paducah,
Kentucky, is hereby authorized, empowered and directed to institute
and prosecute, pursuant to KRS 82.405, an action in McCracken
Circuit Court for a judgment ordering the closing of the street
described in Section 1 above, provided that (1) the City of Paducah
and Western Baptist Hospital, Inc., have entered into a legally
enforceable relocation and reimbursement agreement, acceptable to
the Board of Commissioners, and (2) all necessary approvals of
state and/or federal highway authorities, in appropriate form, have
been received.
SECTION 4. This ordinance shall be read on two separate
days and will become effective upon summary publication pursuant to
KRS Chapter 424.
