ORDINANCE NO. 93 -12 -
AN ORDINANCE CLOSING A PORTION OF KENTUCKY AVENUE BETWEEN
24TH AND 27TH STREETS
WHEREAS, Western Baptist Hospital has requested that a
portion of Kentucky Avenue between 24th and 27th Streets, be
closed; and
WHEREAS, the Planning Commission approved these closings
on December 6, 1993.
THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That the City of Paducah does hereby
authorize the closing of a portion of Kentucky Avenue between 24th
and 27th Streets which are more particularly described as follows:
Beginning at a point in the intersection of the south
right-of-way line of Kentucky Avenue and the east right-
of-way line of 27th Street; thence, along the south
right-of-way line of Kentucky Avenue, North 62 45' 38"
East a distance of 1320.34 feet passing through the
street intersection of 26th Street and 25 Street to the
west right-of-way line of 24th Street; thence, with the
west right-of-way line of 24th Street, North 27 14' 29"
West a distance of 66.00 feet to the north right-of-way
line of Kentucky Avenue; thence, along the north right-
of-way line of Kentucky Avenue, South 62 45' 38" West a
distance of 1320.50 feet to the east right-of-way line of
27th Street; thence, along the east right-of-way line of
27th Street, South 27 22' 43" East a distance of 66.00
feet, to the point of beginning containing 2.001 acres.
SECTION 2. The City is approving the closing of the
right-of-way contingent upon the City maintaining any and all
existing utility easements thereon, over and under the right-of-way
being closed, until as such times as the utilities are relocated
and new easements are dedicated to the City. At which time the
previous easements will be deeded to the appropriate property
owners.
SECTION 3. The Corporation Counsel of the City Paducah,
Kentucky, is hereby authorized, empowered and directed to institute
and prosecute, pursuant to KRS 82.405, an action in McCracken
Circuit Court for a judgment ordering the closing of the street
described in Section 1 above, provided that (1) the City of Paducah
and Western Baptist Hospital, Inc., have entered into a legally
enforceable relocation and reimbursement agreement, acceptable to
the Board of Commissioners, and (2) all necessary approvals of
state and/or federal highway authorities, in appropriate form, have
` been received.

SECTION 4. This ordinance shall be read on two separate
days and will become effective upon summary publication pursuant to
KRS Chapter 424.
