ORDINANCE NO. 93 -12 -
AN ORDINANCE CLOSING ALLEYS BETWEEN 24TH STREET AND 27TH
STREET AND BETWEEN WASHINGTON STREET AND KENTUCKY AVENUE
WHEREAS, Western Baptist Hospital has requested that
alleys between 24th Street and 27th Street and between Washington
Street and Kentucky Avenue be closed; and
WHEREAS, the Planning Commission approved these closings
on December 6, 1993.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION I. That the City of Paducah does hereby
authorize the closing of alleys between 25th, 26th and 27th Streets
between Washington Street and Kentucky Avenue, which are more
particularly described as follows:
16.5 Foot Alley Block 21
Beginning at an iron pin found in the east right-of-way
line of 27th Street, said iron pin being located South 27
22' 43" East a distance of 165.07 feet from the
intersection of the south right-of-way line of Kentucky
Avenue and the east right-of-way line of 27th Street;
thence, from the point of beginning, with the north line
of the herein described alley, North 62 46' 26" East a
distance of 399.40 feet to a point in the west right-of-
way line of 26th Street; thence, South 27 20' 14" East, a
distance of 16.5 feet to a point in the south line of the
herein described alley; thence, with the said alley south
line, South 62 46' 26" West a distance of 399.39 feet to a
point in the east line of 27th Street; thence, North 27 22'
43" West a distance of 16.5 feet back to the point of
beginning, and containing 0.1513 acres.
Also included in this closure:
25 Foot Alley Block 22
Beginning at the point of intersection of the north line
of the herein described alley and the west right-of-way
line of 25th Street, said point being located South 27 15'
41" East a distance of 160.64 feet from an iron pin found
at the intersection of the south right-of-way line of
Kentucky Avenue and the west right-of-way line of 25th
Street; thence, from the point of beginning, South 27
15' 41" East a distance of 25.0 feet to a point; thence,
with the south line of the herein described alley, South
62 45' 40" West a distance of 350.51 feet to a point;
thence, North 27 20' 41" West a distance of 25.0 feet to a
point in the north line of the herein described alley;
thence, with the said north line, North 62 45' 40" East a
distance of 350.54 feet back to the point of beginning
and containing 0.2012 acres.
Also included in this closure:
25 Foot Alley Block 23
Beginning at the point of intersection of the north line
of the herein described alley and the east right-of-way
line of 25th Street, said point being located South 27 15'
41" East a distance of 160.65 feet from the point of
intersection of the south right-of-way line of Kentucky
Avenue and the east right-of-way line of 25th Street;
thence, from the point of beginning, with north line of
the herein described alley, North 62 45' 00" East a
distance of 270.17 feet to a point; thence, with a line

common to a partial alley closure by Paducah City
Ordinance 84-3-2492, South 27 15' 41" East a distance of
25.0 feet to a point; thence, with the south line of the
herein described alley, South 62 45' 00" West a distance
of 270.17 feet to a point; thence, North 27 15' 41" West a
distance of 25.0 feet back to the point of beginning,
containing 0.1550 acres.
SECTION 2. The City is approving the closing of the right-of-way
contingent upon the City maintaining any and all existing utility easements .,
thereon, over and under the right-of-way being closed, until as such time as the Qty
easements are utilities are relocated and new easements are dedicated to the City.
At which time the previous easements will be deeded to the appropriate property
owners.
SECTION 3. The Corporation Counsel of the City of Paducah,
Kentucky, is hereby authorized, empowered and directed to institute and
prosecute, pursuant to KRS 82.405, an action in McCracken Circuit Court for a
judgment ordering the closing of the alley described in Section 1 above, provided
that (1) the City of Paducah and Western Baptist Hospital, Inc . , have entered
into a legally enforceable relocation and reimbursement agreement, acceptable to
the Board of Commissioners, and (2) all necessary approvals of state and/or
federal highway authorities, in appropriate form, have been received.
SECTION 4. This ordinance shall be read on two separate days and
will become effective upon summary publication pursuant to KRS Chapter 424.
