ORDINANCE NO. 94-9- 6/91
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY,
AND BRANDON C. GILLHAM, MICHAEL ROUNDS, AND HIS WIFE, SHANA
ROUNDS, FOR AN ENCROACHMENT UPON CITY RIGHT-OF-WAY
WHEREAS, Brandon C. Gillham, Michael Rounds, and his
wife, Shana Rounds, are the owners of property located at 1722
Alexander Avenue; and
WHEREAS, the City of Paducah is the owner in fee
simple of a 50 foot right of way known as Alexander, and a 50
foot right of way known as Mocquot Street, an improved street,
which intersects the right of way of Alexander Avenue, all of
which is situated in Paducah, McCracken County, Kentucky; and
WHEREAS, Brandon C. Gillham, Michael Rounds, and his
wife, Shana Rounds, are desirous of encroaching upon and
utilizing a portion of said right of way of Alexander Avenue
and Mocquot Street to construct and maintain a private water
line; and
WHEREAS, the City is agreeable to permitting the
aforesaid encroachment by Brandon Gillham, Michael Rounds, and
his wife, Shana Rounds, subject to certain conditions; and
WHEREAS, the City and Brandon Gillham, Michael
Rounds, and his wife, Shana Rounds, have now entered into an
agreement pertaining to the foregoing and do desire that same
be set forth in writing and be made part of the public records
of the City of Paducah, Kentucky, and recorded in the office of
the McCracken County Clerk.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to enter
into an Encroachment Agreement with Brandon Gillham, Michael
Rounds, and his wife, Shana Rounds, for a private water line
for property located at 1722 Alexander Avenue, which will
encroach upon and utilize a portion of Alexander Avenue and
Mocquot Avenue.
SECTION 2. Said Agreement is attached hereto and
incorporated by reference as if fully set out herein.
,y. SECTION 3. Due to property owners taking residence
immediately on said property, an emergency is hereby declared
to exist and this ordinance shall become effective upon one
reading.
