ORDINANCE NO. 94-8-yyg—_2,
AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND
PRELIMINARY DEVELOPMENT PLAN FOR DORRIS DUPERRIEU FERRELL AND
VERNA DILL LOCATED AT 2751 AND 2811 HOLT ROAD FROM R-1, LOW
DENSITY RESIDENTIAL TO MU, MIXED USE ZONE, AND AMENDING THE
PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING
0 BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution passed by the
Paducah Planning Commission on July 18, 1994, and entitled, "A
RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION ON THE PROPOSED ZONE CHANGE AND PRELIMINARY
DEVELOPMENT PLAN FOR DORRIS DUPERRIEU FERRELL AND VERNA DILL
MILLS LOCATED AT 2751 AND 2811 HOLT ROAD," be approved as the
final report of said Commission respecting the matters therein
set forth.
SECTION 2. That the zone classification and the
map amendment proposed in said resolution be, and the same are
hereby, declared to be in agreement with the comprehensive plan
of the City of Paducah.
SECTION 3. That the zone classification of the
following described property be, and it is hereby, changed from
R-1, Low Density Residential to MU, Mixed Use Zone:
Lot No. 53 (2751 Holt Road)
Being Lot No. 53 as shown by the plat of Bellview
Subdivision of record in Plat Book "F", Page 7 in
the McCracken County Court Clerk's Office, said
property presently owned by Verna Dill of record
in Deed Book 761, Page 351 in the aforesaid Court
Clerk's Office and located on the westerly side of
Holt Road, more particularly described as follows:
Beginning at the northeasterly corner of Lot No.
53 aforesaid; thence n. 850-21'-21" W. a distance
of 210.00 feet to the northwest corner of said lot
no. 53; thence S. 040-38'-39" W. a distance of
110.00 feet to the Southwest corner of said lot;
thence along the southerly line of said lot no. 53
S. 850-21'-21" E. a distance of 210.00 feet to the
westerly right-of-way of Holt Road; thence along
said westerly right-of-way line, N. 040-38'-39" E.
a distance of 110.00 feet to the print of
beginning and containing 23,100 square feet or .53
acres.
Lot No. 55 (2811 Holt Road)
Being Lot. No. 55 as shown by the plat of Bellview
subdivision of record in Plat Book "F", Page 7 in
the McCracken County Court Clerk's office said
property presently owned by Dorris Duperrieu of
record in Deed Book 641, Page 95 in the aforesaid
Court Clerk's Office and located on the westerly
side of Holt Road, more particularly described as
follows: Beginning at the northeasterly corner of
Lot No. 55 aforesaid; thence N. 850-32'-38" W. a
distance of 200.00 feet to the Duperrieu's
northwesterly corner; thence S. 040-38'-39" W. a
distance of 98.78 feet to Duperrieu's
southwesterly corner; thence along Duperrieu's
south property line S. 850-21'-21" E. a distance
of 200.00 feet to the westerly right-of-way line
of Holt Road; thence along said westerly
right-of-way line, N. 040-38'-39" E. a distance of
99.44 feet to the point of beginning and
containing 19,822 square feet or 0.46 acres.
SECTION 4. That if any section, paragraph or
provision of this ordinance shall be found to be inoperative, Q(
ineffective or invalid for any cause, the deficiency or•
invalidity of such section, paragraph or provision shall not
affect any other section, paragraph or provision hereof, it being
the purpose and intent of this ordinance to make each and every
section, paragraph and provision hereof separable from all other
sections, paragraphs and provisions.
SECTION 5. This ordinance shall be read on two
separate days and will become effective upon summary publication
pursuant to KRS Chapter 424.
