ORDINANCE NO. 94-10-
AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A
PARCEL OF REAL PROPERTY, A TEMPORARY CONSTRUCTION EASEMENT AND
A TEMPORARY BUILDING REMOVAL EASEMENT FROM MAE LOUISE WYATT, A
WIDOW, FOR THE PURPOSES OF THE RECONSTRUCTION, ALTERATION,
RELOCATION AND IMPROVEMENT OF A PERMANENT PUBLIC ROADWAY KNOWN
AS THE KENTUCKY AVENUE RELOCATION PROJECT, AND AUTHORIZING THE
CONDEMNATION OF SAME
WHEREAS, it is in the public interest and a necessity
for the City of Paducah, Kentucky, to acquire a parcel of real
property consisting of .046 acres for the reconstruction,
alteration, relocation and improvement of a permanent public
roadway known as the Kentucky Avenue Relocation Project, which
extends from South Twenty-third Street to South Twenty-eighth
Street across the real property owned by Mae Louise Wyatt, a
widow; and
WHEREAS, it is necessary for the City of Paducah,
Kentucky, to acquire the aforesaid real property in furtherance
of the public purpose of constructing and maintaining its
roadway system; and
WHEREAS, it is in the public interest and necessity
for the City of Paducah, Kentucky, to acquire a temporary
construction easement and a temporary building removal
easement, across the real property owned by Mae Louise Wyatt,
a widow, for purposes of the construction and maintenance of
all utilities by the City of Paducah, Kentucky, to be retained
until completion of project; and
WHEREAS, the aforesaid easements are needed by the
City of Paducah, Kentucky, in furtherance of the public purpose
of the City of Paducah to provide all essential utilities to
its citizens; and
WHEREAS, the City of Paducah, Kentucky, has been
unable to contract or agree with the owners thereof for the
acquisition or purchase of the real property, granting of a
temporary construction easement and a temporary building
easement, sought to be condemned; and
WHEREAS, the Board of Commissioners of the City of
Paducah, Kentucky, pursuant to the Kentucky Revised Statutes,
does hereby authorize the condemnation of the herein described
real property, a temporary construction easement and a
temporary building removal easement for purposes of the
reconstruction, alteration, relocation, and improvement of the
public roadway known as the Kentucky Avenue Relocation Project,
all of said property being owned by Mae Louise Wyatt, a widow.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the corporation counsel of the City
of Paducah, Kentucky, be and is hereby ordered and directed to
institute condemnation proceedings in the McCracken Circuit

Court in the name of the City of Paducah, Kentucky, against
Mae Louise Wyatt, a widow, and all other parties at interest,
to acquire the necessary real property, a temporary
construction easement and a temporary building removal easement
to be retained until completion of the Kentucky Avenue
Relocation Project, across the subject property owned by the
the aforesaid person.
SECTION 2. That the real property, the temporary
construction easement and the temporary building removal
easement to be acquired is in McCracken County, Kentucky, and
is more particularly described as follows:
PERMANENT RIGHT OF WAY
Beginning at the Northwest corner of the
herein described parcel at the
intersection of the existing South right of
way line of Kentucky Avenue and the existing
East right of way line of South 24th
Street, said point being located 16.45
feet right of Kentucky Avenue Relocation
station 34+88.14; thence, with the existing
South right of way line of Kentucky Avenue,
North 62 degrees 46 minutes 33 seconds
East, 49.98 feet to the Northeast corner of
the herein described parcel, said point
being located 26.36 feet right of Kentucky
Avenue Relocation station 35+39.04;
thence, with the East property line, South
27 degrees 14 minutes 22 seconds East,
27.55 feet to a point in the proposed right
of way line of the Kentucky Avenue Relocation,
said point being located 53.57 feet right
of Kentucky Avenue Relocation station
35+34.36; thence, with the proposed right
of way, South 36 degrees 47 minutes 02
seconds West, 55.64 feet to a point 66.68
feet right of Kentucky Avenue Relocation
station 34+73.92; thence, continuing with
the existing right of way, North 27 degrees
12 minutes 09 seconds West, 51.94 feet to
the point of beginning.
The above described parcel contains 0.046
acres (1,987 sq.ft.).
TEMPORARY CONSTRUCTION EASEMENT
Beginning at a point on the existing East
right of way line of South 24th Street,
66.68 feet right of Kentucky Avenue Relocation
station 34+73.92; thence, along the existing
East right of way line, South 27 degrees 12
minutes 09 seconds East, 64.25 feet to a
point 30.00 feet left of South 24th Street
station 51+25.00; thence, North 62 degrees
44 minutes 59 seconds East, 10.00 feet to a
point 40.00 feet left of South 24th Street
station 51+25.00; thence, North 27 degrees
15 minutes 01 seconds West, 69.10 feet to a
point 64.53 feet right of Kentucky Avenue
Relocation station 34+86.18; thence, along
the proposed right of way line, South 36
degrees 47 minutes 02 seconds West, 11.06
feet to the point of beginning.
The above described parcel contains 0.015
acres (665 sq.ft.).

Being part of the same property conveyed to
the Grantor from Clarabelle Schmidt Rikel,
dated 28 November 1977, as recorded in Deed
Book 600, Page 841, in the McCracken County
Court Clerk's Office.

SECTION 3. This ordinance shall be read on two
