HomeMy WebLinkAbout95-8-5339294 ORDINANCE #95- 9— S 33' J AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A PERMANENT SANITARY SEWER EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT ACROSS A PARCEL OF REAL PROPERTY BELONGING TO MARK D. LINEBERRY TO BE USED BY THE CITY OF PADUCAH, KENTUCKY, TO LAY, MAINTAIN, REPAIR, AND REMOVE A GRAVITY SANITARY SEWER AND AUTHORIZING THE CONDEMNATION OF SAME. WHEREAS, a certain permanent sanitary sewer easement and a temporary construction easement across a parcel of real property owned by Mark D. Lineberry is necessary for the construction and maintenance of a gravity sanitary sewer by the City of Paducah, Kentucky; and WHEREAS, the following described real property is needed by the City of Paducah, Kentucky, in furtherance of the public purpose of the City of Paducah to provide a clean and sanitary sewage disposal system; and WHEREAS, the City of Paducah, Kentucky, has been unable to contract or agree with the owner thereof for the acquisition or purchase of the real property sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of said easements across the herein - described real property pursuant to the Kentucky Revised Statutes; NOW, THEREFORE, be it ordained by the City of Paducah, Kentucky: SECTION 1. That the corporate counsel of the City of Paducah, Kentucky, be and is hereby ordered and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky, against Mark D. Lineberry and all other parties at interest to acquire the necessary easements across the subject property owned by the aforesaid individuals. SECTION 2. That the easement to be acquired is in McCracken County, Kentucky, and is more particularly described as follows: Being a sewer easement for the City of Paducah, consisting of a twenty-five foot wide Permanent Sewer Easement centered on a sewer line owned by the City of Paducah, said sewer line being located west of the city of Paducah, Kentucky, near the Perkins Creek and north of U.S. Highway 62 and being more particularly described as follows: Beginning at a point, said point being located 41.72 feet on a bearing of North 6° 57' 50" West from the northwest corner of the Thomas E. Watson property common to the southwest corner of the Mark D. Lineberry property; thence, from said point of beginning, North 6° 57' 50" West, 26.38 feet along said Lineberry .,,�r:-i'.r--1-�.f ;':i -..�,,-sr.�,-�...c-.�rra�.�'.,.T.r-.—r_. ::. ....7�..,—:..,;, 295 property line to a point; thence leaving said Lineberry line, North 64° 24' 13" East, 337.36 feet to a point; thence, North 33° 26' 37" East, 402.37 feet to a point; thence, North 83° 26' 37" East, 665.04 feet to a point in the line common to Lineberry and the Stephen Jackson property; thence along said common line South 7° 07' 11" West, 25.73 feet to a point; thence leaving said common line, South 83° 26' 37" West, 647.32 feet to a point; thence, South 33° 29' 54" West, 397.64 feet to a point; thence, South 64° 24' 13" West, 352.70 feet to the point of beginning containing 0.8042 acres. (DI In addition, there is also conveyed a Temporary Construction Easement, bounded by a line ten feet parallel to, adjacent to, and beyond the above permanent easement. This conveyance contains an additional 0.322 acres. SECTION 3. In order to expedite the construction of the aforesaid sewer project an emergency is hereby declared to exist, and this ordinance shall become effective with one reading.
