HomeMy WebLinkAbout96-3-5463495 ORDINANCE NO. 96-3 - 546,3 AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract or property adjacent to the present city limits, located west and adjacent to Olivet Church Road and north of U.S. Highway 62, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, the owners have requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah; and WHEREAS, KRS 81A.420 provides that a city may adopt an ordinance finalizing annexation to the city of the territory described in the previously adopted ordinance declaring its intent to annex said property; and WHEREAS, the City of Paducah declared its intent to annex said property by 01i Ordinance No. 95-12-5425 adopted on December 28, 1995. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described property, and therefore that the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky; said real property being more particularly and accurately described as follows: Beginning at the northwesterly corner of Lot G-12 of the Country Club Investments Subdivision, Phase 5, as shown and indicated by plat of said development recorded in plat Section "J", page 1022 of the McCracken County Clerk's Office, said corner being located on the easterly side of the Olivet Church Road or Kentucky Highway 998 at a distance of 1425.01 feet north of the intersection of the centerline of a county road known as Prestwick Place; thence from said point of beginning N. 71°-56'-30" W. crossing said Olivet Church Road, 55.00 feet to the westerly right-of-way line of said road, the same being the easterly line of Lot 17 of a development known as "The Woodlands" as shown and indicated by plat of said lot and development recorded in plat Section "K", page 1300 of the aforesaid clerk's office; thence S. 18°-03'-30" W. along and with the r r westerly right-of-way line of said Olivet Church Road and the easterly line of the "The Woodlands" aforesaid 1,228.59 feet to the southeasterly corner of Lot 2 of said development, said lot corner being located 50.00 feet north of the southerly line of the property described in Deed Book 829 at pages 721, 724, 727 and 730 of the aforesaid clerk's office; thence leaving said Olivet Church Road, N. 72°-44'- 00" W. along and with the southerly lines of Lot numbers 2, 3, 4 and 5 of said development and as shown by the aforesaid plat, 1,582.12 feet to the southwesterly most corner of said Lot Number 5; thence N. 23°-22'-27" W. along and with the westerly lines of Lot Numbers 5, 9, 10 and 11 of said development 1,512.95 feet to the westerly most corner of said Lot Number 11; thence N. 66°- 496 mssr.,.--i..,,i^-.,.,I^^^'^..... !"L^TSn�l, IIlI@�I�R�IE�R'IaIrRIE1�lAl1.91!7..: ,..19"I 1 37'-33" E. along and with the northerly line of said Lot Number 11, a distance of 200.00 feet; thence S. 81°-09'-21" E. with the northerly line of said lot 350.72 feet to the northwesterly corner of Lot Number 12; thence S. 861-28'-40" E. along and with the northerly line of said Lot Number 12 a distance of 245.94 feet; thence S. 73°-06'-00" E. along and with the northerly lines of Lot Numbers 12, 13, 14, 15 and 16 a distance of 1,669.06 feet; thence S. 34°-58'-22" E. along and with the northeasterly lines of Lot Numbers 16 and 17, a distance of 225.57 feet to the westerly right-of-way line of the aforesaid Olivet Church Road 30 feet west of the centerline thereof, thence S. 71°-56'-30" W. crossing the aforesaid Olivet Church Road 50.00 feet to the easterly right-of-way line of said road, the same being the westerly line of Tract No. 1 of the Paducah Country Club, Inc., property as shown and indicated by plat recorded in plat section '7, page 733 of the aforesaid clerk's office, said westerly line also being the present corporate limits of the City of Paducah, Kentucky; thence S. 71°-56'-30" W. continuing with the aforestated line 5.00 feet into the property of said Paducah Country Club, Inc.; thence S. 18°-03'- 30" W. a distance of 32.18 feet to the point and place of beginning. The aforesaid property contains 2,949,103 square feet or 67.702 acres. SECTION 2. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
