ORDINANCE NO. 96 -5 -
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
ENTER INTO A SEWER CONSTRUCTION AGREEMENT WITH FAIRWAYS INC.
AND TRINITY UNITED METHODIST CHURCH FOR CONSTRUCTION OF THE
FAIRWAYS SANITARY SEWER EXTENSION
WHEREAS, Fairways and Trinity are presently in the
process of developing their real property located off
Blandville Road; and
WHEREAS, to develop said property, it is necessary
that said property be provided with sanitation sewer services
by the City of Paducah; and
WHEREAS, the parties have reached an agreement as to
the construction of sanitation sewer lines and do now desire to
set forth this agreement in writing.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and
directed to execute a Sewer Construction Agreement with
Fairways Inc. and Trinity United Methodist Church for the
construction of sanitation sewer lines for real property owned
by Fairways and Trinity, located off Blandville Road.
SECTION 2. Estimated construction costs for the
Fairways Sanitary Sewer Extension are $60,000. Fairways and
Trinity have each agreed to pay one-third (1/3) of the total
estimated cost, or $20,000 each, as its share of the
construction costs prior to connection to said sanitary sewer.
Fairways and Trinity shall each be entitled to one sewer
connection. The City shall have the right to charge Fairways
and Trinity, or any of their assigns, for any additional tap -on
fees in excess of the aforesaid tap -on fees, and shall have the
right to collect all other tap -on fees for any tap -on which is
made outside the tracts of Fairways and Trinity. All tap -ons
shall be made in strict conformance with City Ordinance.
SECTION 2. This ordinance shall be read on two
separate days and will become effective upon summary publi-
cation pursuant to KRS Chapter 424.
