AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AN AGREEMENT WITH WAREHOUSE, INC. FOR CONSTRUCTION OF
A ROADWAY FROM U.S. HIGHWAY 60 TO THE SOUTHEAST SECTION OF
PROPERTY LYING NORTHWEST OF KENTUCKY OAKS MALL
WHEREAS, Warehouse desires to effect extensive
' commercial development on land it owns within the City of

Paducah which will result in substantial property tax revenue
to the City; and
WHEREAS, the City seeks to promote and encourage
development within the city limits; and
WHEREAS, the parties desire to allocate responsi-
bility for costs associated with the road project and protect
the public use of tax funds; and
WHEREAS, the parties acknowledge that the
construction of the roadway is in the public interest by
providing better traffic control in and around the regional
mall area of Paducah.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and
directed to execute an Agreement with Warehouse, Inc. for the
construction of a roadway from U.S. Highway 60 to the southeast
section of property lying northwest of Kentucky Oaks Mall.
SECTION 2. Estimated road construction costs are
$846,000. Cost of purchasing the land, if condemnation is
necessary, and the cost of the court action, including
attorneys' fees and costs, are currently unknown. Allocation
of costs for the City and Warehouse Inc. is set forth in the
foregoing Agreement.
SECTION 3. In order to complete this project during
the current construction season, an emergency is hereby
declared to exist and this ordinance shall become effective
immediately with one reading.
