AN ORDINANCE AUTHORIZING THE CITY TO COLLECT
AND RECOVER REASONABLE ATTORNEY FEES AND
OTHER COSTS AND EXPENSES INCURRED IN THE
COLLECTION AND ENFORCEMENT OF LIENS FOR THE
REASONABLE VALUE OR LABOR AND MATERIALS
USED IN ABATING NUISANCES
WHEREAS, pursuant to KRS 381.770(3) and the BOCA National Property
Maintenance Code as adopted by the City (hereinafter referred to as "BOCA!'), it is unlawful
for the owner of any real property located within the City of Paducah, Kentucky to permit
any structure upon the property to become unfit and unsafe for human habitation, occupancy,
or use, or to permit conditions to exist in the structure which are dangerous or injurious to
the health or safety of the occupants of the structure, the occupants of the neighboring
structures, or other residents of the City; and
WHEREAS, pursuant to KRS 381.770(4) and BOCA, the City has the
statutory right to establish standards and procedures for the enforcement of the foregoing,
including an abatement of the nuisance by demolition; and
WHEREAS, pursuant to KRS 381.770(5) and BOCA, the City is accorded a
lien against any real property subject to any abatement action through demolition for the
reasonable value of labor and materials utilized in remedying any situation upon such real
property; and
WHEREAS, as a part of its standards and procedures for enforcement, the
City desires to authorize collection and recovery of its reasonable attorney fees and other
costs and expenses incurred by the City in regards to any collection and enforcement upon
such liens and the liability secured thereby.
KENTUCKY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
SECTION 1. The City shall be entitled to recover from any responsible party
or parties all reasonable attorney fees and other costs and expenses incurred by the City by
reason of the collection upon and the enforcement of the responsible party or parties'
liability, and the lien which secures same, under the BOCA National Property Maintenance
c Code as adopted by the City or under KRS 381.770.
SECTION 2. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
