HomeMy WebLinkAbout96-9-5566710 ORDINANCE NO. 96-9-56b/a AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION O N THE PROPOSED ZONE CHANGE AND PRELEVIINARY DEVELOPMENT PLAN FOR GENESIS GROUP, INC., LOCATED ON HOLT ROAD FROM R-4, HIGH DENSITY RESIDENTIAL ZONE TO R-1, LOW DENSITY RESIDENTIAL ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on August 5, 1996, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND PRELEVIINARY DEVELOPMENT PLAN FOR GENESIS GROUP, INC. LOCATED ON HOLT ROAD," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from R-4, High Density Residential Zone to R-1, Low Density Residential Zone: Beginning at a concrete monument (found) 25.0 feet east at right angles from the centerline of Holt Road, said centerline point from the centerline intersection of Holt Road and Turnberry Road; thence south 83 degrees 14 minutes 44 seconds east for a distance of 504.23 feet with the north line of the property described in Deed Book 635, Page 41 [passing through an iron pin (found) at 406.46 feet] to a 1/2" diameter rebar with cap (found); thence north 53 degrees 46 minutes 20 seconds east for a distance of 137.69 feet with the west line of the property described in Deed Book 615, Page 672 to a 1/2" diameter rebar with cap (found); thence north 06 degrees 21 minutes 10 seconds east for a distance of 34.08 feet with the west line of said property to a 1/2" diameter rebar with cap (found); thence north 74 degrees 34 minutes 54 seconds east for a distance of 450.18 feet with the north line of said property to a 1/2" diameter rebar with cap (found) in the west line of the property described in Deed Book 701, page 31; thence north 01 degrees 11 minutes 54 seconds west for a distance of 434.31 feet with the west line of said property to a 1/2" diameter rebar with cap (found); thence north 85 degrees 43 minutes 14 seconds west for a distance of 63 9. 10 feet with the south line of Tract II as shown in Plat p Section "T', Page 210 to a concrete monument (found); thence south 04 degrees 31 minutes 52 seconds west for a distance of 138.23 feet with the east line of the property described in Deed Book 635, Page 41 to a concrete monument (found); thence north 85 degrees 03 minutes 16 seconds west for a distance of 350.00 feet with the south line of said property to a concrete monument (found) 25 feet at right angles from the centerline of Holt Road; thence south 04 degrees 31 minutes 37 seconds west for a distance of 551.62 feet with the east line of Holt Road to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
