Attendees: Vice -Chair Joe Benberry, Jim Chapman, Leslie Heath, Gayle Kaler, Chairman Bob Wade Absent: Allan Rhodes, Trey Griffin Staff: Carol Gault, Planning Director; Honorable Counsel Glenn Denton; Joshua P. Fowler - Sommer, Planner III Guests: Marc Buford Chairman Wade called the called meeting of the Paducah Planning Commission to order at 5:30 PM. The Pledge of Allegiance was recited and the roll was taken. Meeting was in the Paducah City Hall Commission Chambers. Chairman Wade noted there were not minutes for May due to lack of agenda items. Vice -Chair Benberry offered: I move that the reading of the minutes for April 6, 2026 be waived and that the minutes of said meeting, as prepared by staff, be approved as written. Commissioner Kaler seconded. No corrections were requested. Chairman Wade called for the vote. 5 Ayes (Benberry, Chapman, Heath, Kaler, Wade), 0 Nays Planning Commission Continued Petitions Planning Commission New Petitions Case #ZON2026-0001 Avenue 837, 857 & 867 McGuire Mr. Fowler -Sommer presented the staff report. He stated the property currently contains a Cross -fit gym and an assisted living facility. A tattoo parlor would like to locate inside the Cross -fit gym. In order to do so, the property would need to be rezoned from R4 to B-1. The proposed rezoning would be in compliance with the City of Paducah/ McCracken County Comprehensive Plan. Vice -Chair Benberry offered: I move that this Commission open the Public Hearing for case ZON2025-0001 pertaining to 837, 857 & 867 McGuire Avenue. Commissioner Chapman seconded. Chairman Wade asked all in favor? 5 Ayes (Benberry, Chapman, Heath, Kaler, Wade), 0 Nays Chairman Wade invited the public to speak. Mr. Marc Buford spoke. He stated the rezoning petition was filed in order to allow the tattoo parlor to open and also for the cross -fit gym to be rebuilt, should it be demolished due to some unforeseen event. Vice -Chair Benberry offered: I move that this Commission close the Public Hearing for case ZON2025-0001 pertaining to 837, 857 & 867 McGuire Avenue. Commissioner Chapman seconded. Chairman Wade asked all in favor? 5 Ayes (Benberry, Chapman, Heath, Kaler, Wade), 0 Nays Vice -Chair Benberry offered: I move that this Commission recommend approval to the Board of Commissioners and adopt a resolution recommending approval thereofofthe requested map amendmentfrom R-4 High Density Residential Zone to B-1 Convenience & Service Zone for property located at 837, 857 and 867 McGuire Avenue. I further move this Commission adopt the following findings offact in support of said recommendation: 1. The existing R-4 Zone is inappropriate for these lots. 2. The B-3 PUD zoning extends down the entire east side of McGuire Avenue. 3. The site is adjacent to the B-1 Zone on the north, therefore spot zoning is negated. 4. A nonconformity would be removed and brought into conformance in accordance with the City of Paducah/ McCracken County Comprehensive Plan. 5. The proposed zone change is in compliance with the Future Land Use Map, adopted as part of the City of Paducah/ McCracken County Comprehensive Plan. 6. The multi family development would be an appropriate buffer between the B-1 Zone and the lower - intensity uses further south along McGuire Avenue. 7. The totality of the lots is approximately 5.73 acres. Therefore, impacts to any surrounding residential uses can be mitigated. 8. The sites have easy vehicular access to all of Paducah. Commissioner Heath seconded. Hearing no questions or comments from the Commissioners, Chairman Wade called for the vote. 5 Ayes (Benberry, Chapman, Heath, Kaler, Wade), 0 Nays Case #TXT2026-0003 Mr. Fowler -Sommer presented the staff report. He stated the intent of the text change was to revise Sections 126-69 and 126-79 in accordance with the new KRS 100.348 taking effect on July 1st. The major change to mobile home parks was to change it to land -lease community, which is a more universally -accepted term and also to allow them in all residential zones. The major changes to qualified manufactured homes is to allow them in all residential zones as along as they meet the performance standards of said zone. Currently, they are not permitted in the R-1 Low Density Residential Zone. Any new homes must face the street of the majority of the homes on the block. MINUTES OF THE PADUCAH PLANNING COMMISSION —continued page 3 / 5 The last major change was that a qualified manufactured home could be placed on a smaller lot (the same with a stick -built home) if it could not meet size or setbacks. Commissioner Heath offered: I move that this Board open the Public Hearing for case =026-0003 pertaining to Section 126-69 Mobile Home Parks and 126-79 Qualified Manufactured Homes of the Paducah Zoning Ordinance. He stated the intent of the text change was to the Low Density Residential Zone, R-1 to introduce performance standards in terms of a permanent foundation and 5:12 roof pitch for any new single-family homes, whether they are qualified manufactured, modular or stick -built. There were images provided in the staff report showing the difference between a 3:12 and 5:12 roof pitch. Commissioner Kaler offered: I move that this Board open the Public Hearing for case =026-0004 pertaining to Section 126-102 Low Density Residential Zone, R-1 of the Paducah Zoning Ordinance. Commissioner Kaler seconded. Mr. Chapman asked if the text change would apply to accessory dwelling units. Mr. Fowler -Sommer stated that ADUs have their own section of text in the Zoning Ordinance and the intent of the text change was for the principal building.
