Chairwoman Young called the called meeting of the Paducah Board of Adjustment to order at 5:30 pm.
The Pledge of Allegiance was recited and the roll was taken. Meeting was in the Paducah City Hall
Commission Chambers.
Mr. McGregor offered:
I move that the reading of the minutes for April 21, 2026 be waived and that the minutes of said meeting,
as prepared by staff, be approved as written.
Vice -Chair Perry seconded.
No changes were requested. Chairwoman Young called for the vote.

700 North 37th Street
Planner III Josh Fowler -Sommer presented the staff report. He stated the request was due to the Petitioner
requesting to protect his view -shed on the west side of the property. However, upon review of the City of
Paducah/ McCracken County Comprehensive Plan, no justification could be found for granting the
variance. Additionally, the Fire Prevention Division has an open code case on the next door property.
Mr. Fowler -Sommer stated the appropriate way to move forward would be to follow up with Fire
Prevention as opposed to a variance being granted.
Mrs. Humphrey offered:
I move that this Board open the Public Hearing for case VAR2026-0005 pertaining to 700 North 37`h
Street.
Vice -Chair Perry seconded.

Chairwoman Young invited the public to speak.
Mr. David Kries, Petitioner, spoke. He discussed the unkept property next door. A six-foot fence would
not block the viewshed on the property line, which lead to the request for an eight -foot fence. He has also
tried to buy the property next door. Mr. Kries further stated the property owners are only present part of
the time.
Vice -Chair Peng asked Mr. Kries if he had considered a fast-growing hedge. Mr. Kries stated a hedge
would take too long to grow. Mr. Fowler -Sommer stated nuisances can be reported anonymously on the
My Paducah app. Mr. Kries preferred not to use the app. Mr. Fowler -Sommer then stated the appropriate
staff to follow up with would be Mr. Les Fugate or Mr. Greg Cherry.
Hearing no further public comment, Chairwoman Young asked the public hearing to be closed.
Mrs. Humphrey offered:
I move that this Board close the Public Hearing for case VAR2026-0005 pertaining to 700 North 37`h
Street.
Mr. McGregor seconded.

Mr. McGregor offered:
I move that this Board deny the petition of David Kries for a two foot variance request to construct an
eight -foot -tall fence on the west property line at 700 North 37`h Street.
I further move that the variance be denied based on the following findings of fact:
1. Goal 2 of the Housing and Neighborhoods Element states: Sustained integrity and value of the
area's oldest established neighborhoods while promoting quality housing development and the
long-term appeal of newer residential areas.
2. The lot itself is nonconforming to the R-1 Low Density Residential Zone, however; is regularly
shaped, being 50'X 160'.
3. Staffcouldnotfind any apolicablepriorities ofthe Board of Commissioners, pursuant to M03028.
4. The Housing and Neighborhoods Element of the City of Paducah/ McCracken County
Comprehensive Plan states "Together with the Land Use and Character section, [this section]
establishes the public policy basis for community planning and local government development
regulations, especially to protect residential areas from incompatible land uses and development
intensities, promote a wide range of housing options and maintain desired neighborhood
character. "
5. Remedies for the removal of nuisances are available to any resident of the City of Paducah which
can be done anonymously.
6. Staff reviewed 154 instances of how neighborhoods are mentioned in the City of Paducah/
McCracken County Comprehensive Plan. There was no element, statement, phrase or
consideration given to taller fences which run averse to neighborhood character.

An active property maintenance case is open on the property and incorporated by reference herein.
The case number is PM2023-0080. The Fire Prevention Division would be the appropriate
channel to ensure compliance with the building code, as opposed to a fence running adverse to
neighborhood character.
Mrs. Humphrey seconded.
Vice -Chair Perry stated recent fence petitions have not been approved and felt that denial was the
appropriate choice. He further stated he has used the My Paducah app before. Vice -Chair Perry stated
Mr. Jonathan Perkins could help with trees or shrubs as he is on the Tree Board.
Hearing no further questions or comments from the Board members, Chairwoman Young called for the
vote.
2 Ayes (Humphrey, Perry), 2 Nays (McGregor, Young)
Mr. Fowler -Sommer stated the vote was tied and the Petition would not move forward. Honorable
Counsel Glenn Denton suggested a different motion could be made. Mrs. Humphrey asked Mr. Kries if
a six-foot fence is not sufficient. Mr. Kries stated that was correct because the rafter tails of the building
could still be seen. Mr. Denton then suggested the matter be tabled until the next meeting so that there
would hopefully be five members. The Board was receptive to that idea.
Mr. McGregor offered a motion to table the Petition to the next meeting.
Vice -Chair Perry seconded.

Case# VAR2026-0007 5400 Cairo Road
Planner III Josh Fowler -Sommer presented the staff report. He stated the Petitioner, RaceTrac, has
requested to have a 103 square foot sign that is off Cairo Road. This request is very similar to a sign the
BOA previously approved for the QuikTrip. It was further stated it is reasonable to expect wayfinding
signage off Cairo Road, as opposed to Interstate signage, as it's purpose is to bring motorists off the
interstate, but not to necessarily get them into the site.
Mrs. Humphrey offered:
I move that this Board open the Public Hearing for case VAR2026-0007 pertaining to 5400 Cairo Road.
Vice -Chair Perry seconded.

Chairwoman Young invited the public to speak.
Mr. David Rodatz, Petitioner, spoke. He stated the entry sign was intended to enhance wayfinding and
capture localized traffic. Mr. Dan Brown with RaceTrac spoke. He stated the QuikTrip had a similar sign
approved and the proposed sign would be 25' tall.
Hearing no further public comment, Chairwoman Young asked the public hearing to be closed.

Vice -Chair Perry offered:
I move that this Board approve the petition of David Rodatz for a variance of 101 square feet for a 103
square foot freestanding sign to be installed at 5400 Cairo Road.
I further move that the variance be approved based on the following findings of fact:
1. The City of Paducah/ McCracken County Comprehensive Plan sets forth Goals which speaks to
the redevelopment of the site and the economic benefits thereof, incorporated by reference herein.
2. The site is large, consisting of 17.95 acres.
3. The interstate sign is intended to attract motorists off Interstate 24, but does not provide a clear,
concise point of entry into the site.
4. The proposed freestanding sign on the corner of the site provides a clear, concise point of entry.
5. In support of KRS 100.243 (b), it is reasonable to have a sign of sufficient size to provide
wayfinding and gasoline pricing.
6. The redevelopment of this site may provide a catalyst for under-utilized parcels nearby.
7. New developments such as new hotels, the Bass Pro Shop and the Sports Park will be mutually
beneficial for the site, thereby enhancing Paducah's overall economy.
8. The character around exit 3 has been changing in recent years with new industrial, commercial
and residential construction.
9. It is reasonable to expect any business that fronts Cairo Road to be able to utilize wayfinding
signage to get into the site.
Mrs. Humphrey seconded.
Chairwoman Young called for the vote.
