MINUTES OF THE PADUCAH PLANNING COMMISSION
APRIL 6, 2026 5:30 P.M.

Attendees: Vice-Chair Joe Benberry, Jim Chapman, Leslie Heath, Gayle Kaler, Allan Rhodes,
Chairman Bob Wade

Chairman Wade called the called meeting of the Paducah Planning Commission to order at 5:30 PM.
The Pledge of Allegiance was recited.
The roll was taken.
Vice-Chair Benberry offered:
I move that the reading of the minutes for March 2, 2026 be waived and that the minutes of said meeting,
as prepared by staff, be approved as written.
Commissioner Rhodes seconded.
No corrections were requested. Chairman Wade called for the vote.

Case #TXT2026-0002
Mr. Fowler-Sommer presented the staff report. He stated the intent of the text change was to change the
lot size, corner stores and setbacks for the R-3 Zone. When zoning was implemented in 1967, the planners
of the time tried a one-size-fits-all approach that was not reflective of the historic pattern. This led to
many nonconforming lots. Corner stores were specifically mentioned before the Planning Commission at
the June 2025 meeting. The City of Paducah/ McCracken County Comprehensive Plan was discussed.
Commissioner Rhodes offered:
I move that this Board open the Public Hearing for case TXT2026-0002 pertaining to Section 126-104
Medium Density Residential Zone, R-3 of the Paducah Zoning Ordinance.
Vice-Chair Benberry seconded.

Chairman Wade invited the public to speak.

No one was present to speak on the proposed text amendment.
Hearing no public comment, Chairman Wade asked the motion to close the public hearing be read.
Commissioner Rhodes offered:
I move that this Board close the Public Hearing for case TXT2026-0002 pertaining to Section 126-104
Medium Density Residential Zone, R-3 of the Paducah Zoning Ordinance.
Commissioner Kaler seconded.
Chairman Wade asked all in favor?

Commissioner Chapman offered:
I move that this Commission adopt a resolution recommending to the Board of Commissioners that case
TXT2026-0002 pertaining to the text amendment of 126-104 Medium Density Residential Zone, R-3 of the
Paducah Zoning Ordinance be adopted.
Vice-Chair Benberry seconded.
Commissioner Rhodes asked about short-term rentals. Mr. Fowler-Sommer stated there is a bill at the
General Assembly that may determine how short-term rentals can be regulated. He further stated a text
amendment is prepared to address short-term rentals.
Commissioner Rhodes asked about parking for the corner stores. Mr. Fowler-Sommer stated parking
would be on-street and people would be able to walk.
Commissioner Rhodes asked about sandwich board signs. Mr. Fowler-Sommer stated the regulation came
from the B-2 Zone.
Hearing no further questions or comments from the Commissioners, Chairman Wade called for the vote.

Case #ZON2026-0100 224 Berger Road
Mr. Fowler-Sommer presented the staff report. He stated the property is in the process of being annexed
into the City of Paducah. The proposed R-4 Zone would allow another medical or office use. The spirit
and intent of the R-4 Zone would be optimal for this lot for buffering and lower-intensity office uses.
Commissioner Chapman offered:
I move that this Board open the Public Hearing for case ZON2026-0001 pertaining to the initial zoning
classification of High-Density Residential Zone, R-4 for property located at 224 Berger Road.
Commissioner Rhodes seconded.
Chairman Wade asked all in favor?

Chairman Wade invited the public to speak.

I move that this Board close the Public Hearing for case ZON2026-0001 pertaining to the initial zoning
classification of High-Density Residential Zone, R-4 for property located at 224 Berger Road.
Commissioner Kaler seconded.

Commissioner Chapman offered:
I move that this Commission recommend approval to the Board of Commissioners and adopt a resolution
recommending approval thereof of the requested initial zoning of R-4 High Density Residential Zone for
property located at 224 Berger Road.
I further move this Commission adopt the following findings of fact in support of said recommendation:
1. The City of Paducah/ McCracken County Comprehensive Plan supports the R-4 Zone in two goals
in the Land Use section.
2. A priority of the Board of Commissioners is Growth, pursuant to MO 3028.
3. The spirit and intent of the R-4 Zone would be fulfilled by providing a buffer between commercial
uses and a single-family home.
4. The current use of the site is an orthopedic office, which is principally permitted in the R-4 Zone.
5. No high-intensity commercial development could be developed on the lot in the future, which
would help to protect the overall character of the neighborhood.
Commissioner Rhodes seconded.
Hearing no questions or comments from the Commissioners, Chairman Wade called for the vote.

Mr. Fowler-Sommer conducted board training.
