Greg Cherry, Deputy Chief/Fire Marshal Building and Electrical Codes Appeals Board Minutes — July 25, 2025 The Building and Electrical Codes Appeals Board was held on Friday, July 25, 2025, in the Commission Chambers in City Hall. In attendance were Paul King, Rick Windhorst, Greg Croft, Chad Beyer, Kerry Fulcher, Jimmy Evans, Jim Garrett, BFW, Youngblood Excavation, Inez Hutchins, Les Fugate, Vaughn Hugen, Greg Cherry, Kristen Krueger, and Janet Dicke. I. The meeting was called to Order by Paul King, Chairman. II. Roll Call Paul King Rick Windhorst Greg Croft Chad Beyer Kerry Fulcher Absent: Jason Hickey III. Approve Minutes The minutes were read and approved. Motion made by Chad Beyer and seconded by Rick Windhorst. Motion carried IV. Update - Findings of the Legal Aspects of Electrical Plan Review — Kristen Krueger Kristen reported that she submitted a request to the Kentucky Attorney General for an official opinion on whether the Code requires electrical plans to undergo critical review or simply need a professional stamp. The Commissioner of the Department of Housing, Building, and Construction informed her that the Attorney General's office reached out to his department for input. We anticipate receiving the Attorney General's opinion by Fall 2025. Once received, we will reassess whether the City should mandate critical review of electrical plans or make it voluntary. This opinion will help clarify the City's position and ensure legal compliance, especially when addressing concerns from contractors, homeowners, and others. V. Riverport Canopy Cover for the Truck Traffic a. Accept proposed canopy as a Type 2B Construction Type separate structure with a minimum of greater than 10 -feet ground clearance between proposed and existing structures. b. As separate structures with ground clearance greater than 10 -feet, then the fire separation distance qualifies as 5 -feet to less than 10 -feet per Table 705.8. c. Per Table 705.8, the exterior wall of the existing structure would need to qualify as Unprotected, Non-sprinklered building which is permitted to have 10% unprotected openings. d. Acceptance is predicated on the fact the existing structure has 2 -hr fire rated exterior walls per Table 601, Construction Type 3B. e. Acceptance is predicated on the building official's agreement that the existing structure maintains perimeter openness along north wall with canopy structure existing above 7 -feet ground plane allowing for fire -fighting access. f. Acceptance is predicated on the apparent low hazard of fertilizer loading through a covered chute system. Motion made by Paul King and seconded by Kerry Fulcher. Motion carried. VI. Local Appeals Board — Kristen Krueger In March 2025, KRS 227.325 was amended to permit cities to appoint a local appeals board to hear appeals from orders issued enforcing fire prevention and protection codes. The Building and Electrical Appeals Board has the statutory qualifications to begin hearing those appeals in the City of Paducah. VII. Adjourn — Motion made by Paul King and seconded by Rick Windhorst. Motion carried.
