Paducah City Hall Commission Chambers Attendees: Lisa Humphrey, Mark McGregor, Chairwoman Carol Young Absent: Brandi Harless, Vice Chair Patrick Perry Staff: Joshua P. Fowler-Sommer, Planner III, Guests: Larry Caldwell, Joe Griffin, Justin Calhoun, Tracy Kenson Chairwoman Young called the regular meeting of the Paducah Board of Adjustment to order at 5:30 pm. The Pledge of Allegiance to the U.S. flag was recited. The roll was taken. Mr. Fowler-Sommer stated with Vice Chair Perry and Ms. Harless being out, the original members were not present to vote on the September 29th or October 27th minutes. Continued Petitions New Petitions Case# VAR2025-0012 2404 Lone Oak Road Planner III Josh Fowler-Sommer stated the Petitioner’s professional representative had requested to table the hearing until the January meeting. He further stated the same was requested of 3325 Park Avenue. Since the public hearing was advertised, the public hearing must be opened and then the items tabled. Hearing no questions from the Board members, Chairwoman Young asked for the public hearing to be opened and tabled. Mrs. Humphrey offered: I move that this Board open the public hearing for case for VAR2025-0012 pertaining to 2404 Lone Oak Road. I further move that this Board table this petition at the request of the Petitioner’s professional representative to the regularly scheduled meeting on January 26, 2026. Mr. McGregor seconded. Chairwoman Young asked all in favor? 3 Ayes (Humphrey, McGregor, Young), 0 Nays Case# USE2025-0009 1036 River Oaks Boulevard Planner III Josh Fowler-Sommer presented the staff report. He stated a short-term rental is a conditional use in the R-3 Zone. The house has three bedrooms and two bathrooms. The number of guests would be limited to no more than six at a time. The site is located near the Regional Trade Center and Midtown Paducah. The Petitioner does not have a targeted demographic but would benefit from the new Paducah-McCracken County Sports Park, which is nearby. Parking would be off-street with four spaces in the driveway. Mr. Fowler-Sommer also stated additional conditions were being proposed as well. Mr. McGregor offered: I move that this Board open the Public Hearing for case USE2025-0009 pertaining to 1036 River Oaks Boulevard. Mrs. Humphrey seconded. Chairwoman Young asked all in favor? 3 Ayes (Humphrey, McGregor, Young), 0 Nays Chairwoman Young invited the public to speak. Mr. Calhoun, Petitioner, was present but chose not to speak. Hearing no public comment, Chairwoman Young asked the public hearing to be closed. Mr. McGregor offered: I move that this Board close the Public Hearing for case USE2025-0009 pertaining to 1036 River Oaks Boulevard. Mrs. Humphrey seconded. Chairwoman Young asked all in favor? 3 Ayes (Humphrey, McGregor, Young), 0 Nays Mrs. Humphrey offered: I move that this Board approve the conditional use request of Justin Calhoun for a short-term rental to be located in the R-3 Zone at 1036 River Oaks Boulevard. I further move that the approval be based on the following findings of fact: 1. The site has convenient ingress and egress to Park Avenue, a major arterial near this location. 2. The site has convenient ingress and egress to North 32nd Street, a State highway, that serves as a major collector street. 3. The number of guests will be limited to no more than six at a time. The site is located near Paducah’s west end, giving guests easy access to shopping, dining and entertainment in downtown Paducah, Midtown and the Regional Trade Center. 5. The City of Paducah historic districts are nearby, affording guests a unique cultural view. 6. Staff anticipates no more than three vehicles parked on the property at any one time. 7. The site is approximately ¾ mile from Noble Park, one mile from Carson Park and two miles from Brooks Stadium, thereby providing outdoor recreational opportunities. 8. This particular STR would be optimal for housing families for traveling sports teams at the nearby Paducah/ McCracken County Sports Plex. I further move that the STR shall be deemed to have closed and the Conditional Use permit suspended if: 1. The transient room tax has not been paid to the McCracken County Treasurer for the last two months; and/or 2. The property owner is delinquent in filing and payment of the City of Paducah business license for two or more tax years. Mr. McGregor seconded. No further questions were asked. Chairwoman Young called for the vote. 3 Ayes (Humphrey, McGregor, Young), 0 Nays Case# VAR2025-0014 2722 Fairmont Street Planner III Josh Fowler-Sommer presented the staff report. He stated the Petitioner is requesting a four-foot side yard variance to construct a new storage building two feet from the side property line. The proposed storage building would be 540 square feet. Staff’s preference is to grant a variance as opposed to the interior property line being abolished. This lot is over 8,000 square feet and is a viable building lot. The variance would also maximize the distance from the home to the south and would allow the site to function as a cohesive unit. Mr. Fowler-Sommer further stated the total building footprint of all accessory buildings shall not exceed the gross floor area of the principal building, pursuant to Section 126-86 (a) (4) of the Paducah Zoning Ordinance. The Petitioner will be responsible for ensuring this requirement is met. Mr. McGregor offered: I move that this Board open the Public Hearing for case VAR2025-0014 pertaining to 2722 Fairmont Street. Mrs. Humphrey seconded. Chairwoman Young asked all in favor? 3 Ayes (Humphrey, McGregor, Young), 0 Nays Chairwoman Young invited the public to speak. Ms. Tracy Kenson, Petitioner’s sister, spoke. She stated both lots had been under the same ownership since June of 1986. She further stated both lots were on one deed. Hearing no further public comment, Chairwoman Young asked the public hearing to be closed. Mrs. Humphrey seconded. Chairwoman Young asked all in favor? 3 Ayes (Humphrey, McGregor, Young), 0 Nays Mr. McGregor offered: I move that this Board approve the petition of Joe Griffin for a four-foot variance request into the north setback to place a new storage building two feet from the side property line at 2722 Fairmont Street. I further move that the variance be approved based on the following findings of fact: 1. The proposed location of the storage building would contribute to the entire site functioning cohesively. 2. The proposed location reduces crowding on the house to the south at 2726 Fairmont Street. 3. Green space is preserved, which helps with overall stormwater runoff. 4. This lot is a viable building lot, being over 8,000 square feet and having 50’ of frontage. Therefore, staff prefers the granting of a variance as opposed to the central property line being abolished. I further move that the validation approved herein is contingent upon Section 126-86 (a) (4) of the Paducah Zoning Ordinance. Mrs. Humphrey seconded. No further questions were asked. Chairwoman Young called for the vote. 3 Ayes (Humphrey, McGregor, Young), 0 Nays Case# VAR2025-0015 1016 Brown Street Planner III Josh Fowler-Sommer presented the staff report. He stated the Petitioner is requesting an eight-foot front yard variance to add an addition to a batting cage 17 feet from the front property line. The proposed addition would be 6,100 square feet. The site also contains a screen printing and embroidery business. Mr. Fowler-Sommer further stated Brown Street consists of mostly industrial and commercial uses, as opposed to residential. Several buildings are within the front yard setback, including a permanent garage next door, a building for vehicular restoration across Brown Street and a metal carport on this site. The BOA has granted variances in the vicinity before. The purpose of the greater setbacks associated with the M-1 Zone is to absorb industrial accidents if they occur. However, the screen-printing business and batting cage have no operations which would contribute to a larger setback, meaning no hazardous chemicals or processes are used at the site. Therefore, a smaller setback would be amenable. Mrs. Humphrey offered: I move that this Board open the Public Hearing for case VAR2025-0015 pertaining to 1016 Brown Street. He stated the existing batting cage is 36’ X 70”. The proposed addition would be approximately two feet behind the permanent garage next door. Hearing no further public comment, Chairwoman Young asked the public hearing to be closed. Mrs. Humphrey offered: I move that this Board close the Public Hearing for case VAR2025-0015 pertaining to 1016 Brown Street. Mr. McGregor seconded. Chairwoman Young asked all in favor? 3 Ayes (Humphrey, McGregor, Young), 0 Nays Mrs. Humphrey offered: I move that this Board approve the petition of Larry Caldwell for an eight-foot variance request into the north setback to construct a batting cage addition 17 feet from the front property line at 1016 Brown Street. I further move that the variance be approved based on the following findings of fact: 1. This site is surrounded by automotive uses, as opposed to residential. 2. The permanent accessory structure next door at 1028 Brown Street is located approximately 16 feet from the property line. The proposed addition would be at least one foot behind this structure. 3. The vehicular assembly building located at 1031 Brown Street is very close to the front property line. 4. An existing metal car port on this site is approximately 10.5’ feet from the front property line. 5. The BOA granted a front and side yard variance to the truck repair building at 806 Brown Street on February 24, 1997, prior to that site being rezoned in 1999. 6. There are no hazardous chemicals or processes utilized at the site, which negates the need for a larger setback. 7. Quality of Life for Paducah’s residents would be enhanced in accordance with MO 3028. Mr. McGregor seconded. No further questions were asked.
