MINUTES OF THE PADUCAH BOARD OF ADJUSTMENT
SEPTEMBER 29, 2025 5:30 P.M.
Paducah City Hall Commission Chambers
Attendees: Brandi Harless, Vice-Chair Patrick Perry, Chairwoman Carol Young Absent: Jim Chapman
Staff: Joshua P. Fowler-Sommer, AICP, Planner III; Honorable Counsel Glenn Denton
Guests: Chairwoman Young called the regular meeting of the Paducah Board of Adjustment to order at 5:30 pm.
The Pledge of Allegiance to the U.S. flag was recited.
The roll was taken.
Vice-Chair Perry offered:
I move that the reading of the minutes for September 3, 2025 be waived and that the minutes of said meeting, as prepared by staff, be approved as amended.
Ms. Harless seconded.

Case# VAR2025-0009 729 South 13th Street
Variance request from the north and south property lines.
Planner III Josh Fowler-Sommer presented the staff report. He stated the Petitioner is requesting a
variance of one foot on the north and south property lines for a new single-family home to be constructed five feet from the side property lines. This home is a cottage bungalow.
The lot is nonconforming to the R-3 Zone. It is 35’ wide and contains 5,075 square feet. The prescribed standards are 50’ wide and a total of 8,000 square feet. The lot to the north is vacant and the Tennessee
Street ROW forms the southern line. Tennessee Street is a stub street with no through traffic.
Mr. Fowler-Sommer further stated the variance is supported by the Comprehensive Plan, specifically Goals for Land Use & Community Character and Goals for Housing & Neighborhoods. He stated the Board of Commissioners has made Southside Revitalization, Quality Housing and Quality of Life priories for 2025 and 2026 pursuant to MO 3028. He further stated the Kentucky Housing Corporation has
determined that McCracken County needs 3,805 for-sale and rental units to keep up with demand.
Hearing no questions from the Board members, Chairwoman Young asked for the public hearing to be opened.

Chairwoman Young invited the public to speak.
Mr. Heisem Jeiven was present with his mother and father. They own the property directly north of the
subject property. Mr. Jeiven stated they did not wish to give a foot up. They have plans to put a
manufactured home on their property. It was quickly determined a language barrier was causing confusion with the nature of the request. Ms. Harless explained that the new home would be five feet from their property line, not encroaching on their property. The Jeivens were satisfied with the explanation.
Hearing no further public comment, Chairwoman Young asked the public hearing to be closed.

Ms. Harless offered:
I move that this Board approve the petition of Shellia Kirkendoll for a one-foot variance request into the
north and south setbacks to construct a new single-family home five feet from the side property lines at 729
South 13th Street.
I further move that the variance be approved based on the following findings of fact:
1. The City of Paducah Comprehensive Plan sets forth an overarching planning theme throughout
the Plan to increase quantity and variety of housing options. 2. Goal 2 of Land Use and Community Character states: A land use allocation and pattern that advances the area’s key objectives of achieving greater housing supply and variety and supporting
its economic development and tax base needs.
3. Goal 1 of Housing and Neighborhoods states: A quantity and diversity of housing options that
makes living in Paducah and McCracken County attainable and inviting for a wide range of age groups and income levels, including those critical to the area’s economic success. 4. The Southside Revitalization, Quality Housing and Quality of Life are priorities of the Board of
Commissioners, pursuant to MO 3028.
5. The adjacent Tennessee Street is not a through-street, meaning there is no residential traffic on
this street. 6. The adjacent lot next door is vacant. 7. It is reasonable for the Petitioner to center the home on the lot, therefore; the requesting of the variance is necessary.
8. The home is a cottage bungalow, which fits with the fabric of the neighborhood.
9. This development would boost the supply and demand of housing in McCracken County.

10. The current number of for-sale and rental units needed in McCracken County needed is 3,805 according to the Kentucky Housing Corporation.
11. The variance for the new home is supported in the Southside Revitalization Plan, specifically by
the Plan Objectives for Community Renewal.
12. The new home would help to contribute to the re-creation of the former street wall along South 13th Street. 13. The variance would help to maintain a more spacious site which contributes to green space and
less storm water runoff.
14. The lot is nonconforming to the performance standards of the R-3 Medium Density Residential
Zone, specifically to lot width and size. 15. The lot is 35’ wide and has a total area of approximately 5,075 square feet. 16. The Petitioner wishes to construct a home larger than the minimum size of 507 square feet, which
contributes to neighborhood stability and fabric.
Vice-Chair Perry seconded.

Case# USE2025-0005 1722 Madison Street
Conditional Use request to permit a short-term rental in the R-2 Zone.
Planner III Josh Fowler-Sommer presented the staff report. He stated a short-term rental is a conditional use in the R-2 Zone. The house has two bedrooms and two bathrooms. The number of guests would be
limited to no more than four at a time, excluding infants. The site is located centrally in Paducah. The
Petitioner’s target demographic is traveling professionals. Parking would be one-street with two parking spaces off the alley.
Vice-Chair Perry asked about the team members on the EnerGov list who reviews. Mr. Fowler-Sommer stated each project usually has Planning, Engineering and Fire Prevention that review each case. Mr.
Perry asked if there were relevant permits that needed to be issued by the Fire Prevention Division. Mr.
Fowler-Sommer stated the only major building permit was issued in 1978 to change the single-family structure to two-family.
Ms. Harless asked if other short-term rentals had been approved in the neighborhood. Mr. Fowler-Sommer and Chairwoman Young confirmed an approval had been given in the 1600 block of Monroe Street. Mr.
Fowler-Sommer further stated no comments had been received from the public. He further explained a
possible text amendment regarding short-term rentals may be forthcoming. It was further stated that Mr. Les Fugate, Chief Building Official, was working with the Petitioners on obtaining their building permit. Ms. Harless offered:

Vice-Chair Perry offered:
I move that this Board approve the conditional use request of Isaac & Alexis Marrs for a short-term rental to be located in the R-2 Zone at 1722 Madison Street.
I further move that the approval be based on the following findings of fact:
1. The site has convenient ingress and egress to Martin Luther King Jr. Drive/ Park Avenue, both of
which are major arterials near this location.
2. The site has convenient ingress and egress to Fountain Avenue, the major north/ south collector street.
3. The number of guests will be limited to no more than four at a time, excluding infants.
4. The site is centrally located within the City of Paducah, giving guests easy access to shopping,
dining and entertainment in the downtown area, southside and at the Regional Trade Center.
5. The City of Paducah historic districts are nearby, affording guests a unique cultural view.
6. Staff anticipates no more than two vehicles to be parked on the property at any one time and two accommodated by on-street parking in front of the lot.
7. The site is approximately one mile from Noble Park, 3/4 mile from Carson Park and almost a mile
from Brooks Stadium, thereby providing outdoor recreational opportunities.
8. The targeted demographic is traveling professionals.

Case# USE2025-0006 101 Iroquois Drive
Conditional Use request to permit a home occupation in the R-2 Zone.
Planner III Josh Fowler-Sommer presented the staff report. He stated a home occupation is a conditional
use in the R-2 Zone. The Petitioner requests approval to do massage therapy, facials and waxing in her
home. She would be the only employee and have one client at a time. The home occupation would be operated under limited hours on Wednesday through Friday and some Saturdays from 10 a.m. to 5 p.m.

The site is on the corner of Iroquois Drive and Lone Oak Road, which provides quick and easy access to all of Paducah.

Ms. Heather Wurth, Petitioner, spoke. She stated due to health reasons, she needed to minimize her working hours by working with former clients. She stated there is less stress with a home occupation.

I move that this Board approve the conditional use request of Heather Wurth for a home occupation to be located in the R-2 Zone at 101 Iroquois Drive.
I further move that the approval be based on the following findings of fact:
1. The site has convenient ingress and egress to Lone Oak Road by which all of Paducah’s residents
can assess the site quickly and easily.
2. The Petitioner will be the only employee.
3. One client will be seen at a time.
4. Staff anticipates no more than two vehicles to be parked on the property at any one time
5. The home occupation would have limited hours of operation.
