Fowler-Sommer, Planner III; Honorable Counsel Glenn Denton Guests: Dustin Hawkins, Darren Hack, Patrick Lipford, Thomas Lipford Chairman Wade called the regular meeting of the Paducah Planning Commission/ URCDA to order at 5:30 PM. The Pledge of Allegiance was recited. The roll was taken. Commissioner Rhodes offered: I move that the reading of the minutes for July 7, 2025 be waived and that the minutes of said meeting, as prepared by staff, be approved as written. Commissioner Griffin seconded. No corrections were requested. Chairman Wade called for the vote. 5 Ayes (Benberry, Griffin, Heath, Rhodes, Wade), 0 Nays URCDA New Petitions Planning Commission Continued Petitions Planning Commission New Petitions Case # ZON2025-0100 1541 Olivet Church Road Proposed initial zoning of R-4 High Density Residential Zone. Mr. Fowler-Sommer presented the staff report. He stated the site has had first reading for annexation. The Petitioner has requested an initial R-4 zoning designation upon annexation. The site consists of 20,480 square feet and contains a real estate office. Mr. Fowler-Sommer explained the real estate office would be a principally permitted use in the R-4 Zone, as opposed to nonconforming in the current Urbanizing Residential Zone in McCracken County. Traffic counts were discussed. Olivet Church Road would provide a transition point from the residential character to a use of the highest and best use of the lot. The R-4 Zone would provide a more comprehensive utilization of the property while maintaining the pastoral nature of the lots to the east. The City of Paducah Comprehensive Plan and Board of Commissioner’s priorities were discussed. The purpose of the R-4 Zone is to combine residential and business uses in such a manner that it will buffer low density residential property from high density and commercial uses. Commissioner Heath offered: I move that this Commission open the Public Hearing for case ZON2025-0100 pertaining to 1541 Olivet Church Road. Vice-Chair Benberry seconded. Chairman Wade called for the vote. 5 Ayes (Benberry, Griffin, Heath, Rhodes, Wade), 0 Nays Mr. Patrick Lipford (1551 Olivet Church Road) spoke. He stated a stable is operated on his property. The stable is predominately used to teach young ladies how to ride horses. Mr. Lipford stated Mr. Hack was a good neighbor. He further stated he was concerned about the future use of the property. Hearing no further public comment, Chairman Wade asked the motion to close the public hearing be read. Commissioner Heath offered: I move that this Commission close the Public Hearing for case ZON2025-0100 pertaining to 1541 Olivet Church Road. Commissioner Rhodes seconded. Chairman Wade called for the vote. 5 Ayes (Benberry, Griffin, Heath, Rhodes, Wade), 0 Nays Commissioner Heath offered: I move that this Commission recommend approval to the Board of Commissioners and adopt a resolution recommending approval thereof of the requested initial zoning of R-4 High Density Residential Zone for property located at 1541 Olivet Church Road. I further move this Commission adopt the following findings of fact in support of said recommendation: Olivet Church Road provides a discernable boundary between residential properties to the east and the proposed R-4 Zone to the west. This location would be a transition spot between the pastoral residential lots and land uses that are of a higher and better use than residential. The City of Paducah Comprehensive Plan supports the R-4 Zone in two goals in the Land Use section. A priority of the Board of Commissioners is Growth. The spirit and intent of the R-4 Zone would be fulfilled by providing a buffer between a commercial use and low-density housing. Traffic counts range from 8,304 vehicles a day in 2022 near Mayfield Metropolis Road and 10,076 vehicles a day in 2024 near North Friendship Road along Highway 62. The closest traffic counts are 1,625 vehicles a day in 2024 on Olivet Church Road at Circle Lake Drive. No high-intensity commercial development could be developed on the lot in the future, which would help to protect the overall character of the neighborhood. Vice-Chair Benberry seconded. Chairman Wade asked if any of the Commissioners had any questions or comments. No questions were asked. Chairman Wade called for the vote. 5 Ayes (Benberry, Griffin, Heath, Rhodes, Wade), 0 Nays Case # ZON2025-0101 6615 Blandville Road Proposed initial zoning of R-4 High Density Residential Zone. Mr. Fowler-Sommer presented the staff report. He stated the site has had first reading for annexation. The Petitioner has requested an initial R-4 zoning designation upon annexation. The site consists of 18,030 square feet and is vacant. Mr. Fowler-Sommer stated the Petitioner’s intent was not a high-traffic generator, such as a restaurant or retail. Traffic counts were discussed. Olivet Church Road would provide a transition point from the residential character to a use of the highest and best use of the lot. The R-4 Zone would provide a more comprehensive utilization of the property while maintaining the pastoral nature of the lots to the east. The City of Paducah Comprehensive Plan and Board of Commissioner’s priorities were discussed. His concern was how “valley-ish” it is, meaning it would be difficult to develop. He also stated there was one access point that District One Highways would allow. He further stated he wanted the Commission to be aware of the drainage and access for the property. Mr. Darren Hack (part owner of 1541 Olivet Church Road) spoke. He stated there was an easement to 6615 Blandville Road. Hearing no further public comment, Chairman Wade asked the motion to close the public hearing be read. Mr. Fowler-Sommer presented the staff report. He stated the intent of the rezoning is to create a laydown yard for construction equipment and vehicles. A second phase of improvements could involve flex space could consist of an office with a garage. The site is adjacent to the M-1 Zone on the south and west. The parcel contains 18,800 square feet. Mr. Fowler-Sommer stated the Future Land Use Map shows the parcel to be Neighborhood Conservation. However, due to various reasons, the existing zoning is inappropriate for the lot and the M-1 Zone would be appropriate. This area of Paducah is transitional in nature. Vice-Chair Benberry offered: I move that this Commission open the Public Hearing for case ZON2025-0003 pertaining to 1118 North 8th Street. Commissioner Rhodes seconded. Chairman Wade called for the vote. 5 Ayes (Benberry, Griffin, Heath, Rhodes, Wade), 0 Nays No one spoke for or against the Petition. Hearing no public comment, Chairman Wade asked the motion to close the public hearing be read. Vice-Chair Benberry offered: I move that this Commission close the Public Hearing for case ZON2025-0003 pertaining to 1118 North 8th Street. Commissioner Heath seconded. Chairman Wade called for the vote. 5 Ayes (Benberry, Griffin, Heath, Rhodes, Wade), 0 Nays Vice-Chair Benberry offered: I move that this Commission recommend approval to the Board of Commissioners and adopt a resolution recommending approval thereof of the requested map amendment from R-4 High Density Residential Zone to M-1 Light Industrial Zone for property located at 1118 North 8th Street. I further move this Commission adopt the following findings of fact in support of said recommendation: The existing R-4 Zone is inappropriate for this lot. North 8th Street, a minor arterial, forms the southern boundary of the site. The site is adjacent to the M-1 Zone on the south and west, therefore spot zoning is negated. The site is intended to provide a laydown yard for vehicles and equipment, which is the exact same land use next door. The requirement to change the zone classification as outlined in KRS 100.213 (a) have been met. North 8th Street generates traffic and noise, which is not conducive to residential development. The traffic counts were 3,564 vehicles a day in 2023. Industrial uses are located south and west of this site. This is a transitional area of the City of Paducah, with a church and Anderson Court providing a buffer from the industrial character of the remainder of North 8th Street. Land uses not conducive to residential development are located nearby such as adult uses, a lumberyard and sewer facilities. Commissioner Griffin seconded. Chairman Wade asked if any of the Commissioners had any questions or comments. Commissioner Rhodes noted the salvage yard was nearby as well. No questions were asked.
