Fowler-Sommer, AICP, Planner III; Honorable Counsel Glenn Denton Guests: Wayne Walden, Pedro Gonzalez, Mary Mackey Chairwoman Young called the called meeting of the Paducah Board of Adjustment to order at 5:30 pm. The Pledge of Allegiance to the U.S. flag was recited. The roll was taken. Vice-Chair Perry offered: I move that the reading of the minutes for June 30, 2025 be waived and that the minutes of said meeting, as prepared by staff, be approved as amended. Mr. Chapman seconded. Chairwoman Young noted that Ms. Harless was listed as both present and absent. Mr. Fowler-Sommer stated he would make the correction and get Chairwoman Young’s signature on the minutes at the next meeting. Chairwoman Young called for the vote. 4 Ayes (Boykin, Chapman, Perry, Young), 0 Nays Continued Petitions New Petitions Case# VAR2025-0006 100 Vermont Street Variance request from the east and west property lines. Mr. Chapman stated he was going to recuse himself. Mr. Chapman then left the room. Planner III Josh Fowler-Sommer presented the staff report. He stated the Petitioner is requesting a variance of 20 feet on the west and 17 feet on the east for new multi-family structures to be constructed five and eight feet from the front and rear property lines. There will be a total of 32 units as approved previously by the Board. He further stated the site has physical constraints as a TVA power line traverses the site, which reduces the buildable area by 32.75%. The second constrain on the site was a street reservation for the Philips Park Subdivision. The functionality of the street reservation is to protect the ditch that separates this development from the commercial properties on Lone Oak Road. It ranges from 125 to 83 feet wide. Mr. Fowler-Sommer further stated the variance is supported by the Comprehensive Plan, specifically Goals for Land Use & Community Character and Goals for Housing & Neighborhoods. He stated the Board of Commissioners has made Quality Housing and Quality of Life priories for 2025 and 2026. He further stated the Kentucky Housing Corporation has determined that McCracken County needs 2,288 rental units to keep up with demand. Hearing no questions from the Board members, Chairwoman Young asked for the public hearing to be opened. Mrs. Boykin offered: I move that this Board open the Public Hearing for case VAR2025-0006 pertaining to 100 Vermont Street. Vice-Chair Perry seconded. Chairwoman Young called for the vote. 3 Ayes (Boykin, Perry, Young), 0 Nays Chairwoman Young invited the public to speak. Mr. Pedro Gonzales (2938 Clark Street) spoke. He stated he was in favor of the variances. Hearing no further public comment, Chairwoman Young asked the public hearing to be closed. Vice-Chair Perry offered: I move that this Board close the Public Hearing for case VAR2025-0003 pertaining to 100 Vermont Street. Mrs. Boykin seconded. Chairwoman Young called for the vote. 3 Ayes (Boykin, Perry, Young), 0 Nays Vice-Chair Perry offered: I move that this Board approve the petition of Chapman Property Development, LLC for a 20-foot variance request on the west and a 17-foot variance request on the east property line to construct new multi-family structures five and eight feet from the front and rear property lines at 100 Vermont Street. I further move that the variance be approved based on the following findings of fact: The City of Paducah Comprehensive Plan sets forth an overarching planning theme throughout the Plan to increase quantity and variety of housing options. Goal 2 of Land Use and Community Character states: A land use allocation and pattern that advances the area’s key objectives of achieving greater housing supply and variety and supporting its economic development and tax base needs. Goal 1 of the Housing and Neighborhoods states: A quantity and diversity of housing options that makes living in Paducah and McCracken County attainable and inviting for a wide range of age groups and income levels, including those critical to the area’s economic success. Quality Housing and Quality of Life are priorities of the Board of Commissioners, pursuant to MO 3028. The TVA power line easement reduces the buildable area by 32.75%. The street reservation in the unrecorded Philips Park Subdivision is between 125 and 83 feet wide. The practical functionality of the street reservation is to protect a ditch and provide a buffer between this residential development and the commercial properties facing Lone Oak Road. This development would boost the supply and demand of housing in McCracken County. The current number of rental units needed in McCracken County needed is 2,288 according to the Kentucky Housing Corporation. The easternmost building would be approximately 227 feet away from the nearest single-family home, thereby providing the nearby residents a quiet environment. There will be one point of ingress/ egress onto Nolan Drive, thereby negating any traffic on local streets. This point of ingress/ egress would be approximately 375 feet from Lone Oak Road. The variance would help to maintain a more spacious site which contributes to green space and less storm water runoff. Mrs. Boykin seconded. No questions were asked. Chairwoman Young called for the vote. 3 Ayes (Boykin, Perry, Young), 0 Nays After the vote, Mr. Chapman rejoined the meeting. Case# USE2025-0003 2938 Clark Street Conditional Use request to permit a short-term rental in the R-2 Zone. Planner III Josh Fowler-Sommer presented the staff report. He stated a short-term rental is a conditional use in the R-2 Zone. The house has four to five bedrooms and two bathrooms. The number of guests would be limited to no more than ten at a time. The site is located centrally in Paducah. The Petitioner’s target demographic is nurses, contractors, insurance sales and families with children. Parking would be handled via a gravel pad in the front and a side yard driveway. Hearing no questions from the Board members, Chairwoman Young asked for the public hearing to be opened. Mrs. Boykin offered: I move that this Board open the Public Hearing for case USE2025-0003 pertaining to 2938 Clark Street. Mr. Chapman seconded. Chairwoman Young called for the vote. 4 Ayes (Boykin, Chapman, Perry, Young), 0 Nays Chairwoman Young invited the public to speak. Mr. Wayne Walden (2937 Clark Street) spoke. He spoke in favor of the Conditional Use permit. He further stated the house had been fixed up and was a great addition to the neighborhood. Mr. Walden stated Mr. Gonzalez was a good neighbor. Mr. Pedro Gonzales (2938 Clark Street) spoke. He stated he had been in Paducah for two years after moving from Mayfield. He explained he has a business of obtaining foreclosed properties and fixing them up for new residents. The approval of the Conditional Use permit would help facilitate funds to obtain foreclosed houses. Also, many original features of the house were kept in the remodel. Ms. Mary Mackey (2406 Madison Street) spoke. She asked why she received a public notice for this property. Chairwoman Young explained the next case was on Monroe Street. Ms. Mackey appeared to be attending for that case. Hearing no further public comment, Chairwoman Young asked the public hearing to be closed. Vice-Chair Perry offered: I move that this Board close the Public Hearing for case USE2025-0003 pertaining to 2938 Clark Street. Mrs. Boykin seconded. Chairwoman Young called for the vote. 4 Ayes (Boykin, Chapman, Perry, Young), 0 Nays Vice-Chair Perry offered: I move that this Board approve the conditional use request of Pedro Gonzalez for a short-term rental to be located in the R-2 Zone at 2938 Clark Street. I further move that the approval be based on the following findings of fact: The site has convenient ingress and egress to South 28th Street, a minor arterial in this location. The site has convenient ingress and egress to Jackson Street and Park Avenue, both of which are major arterials. The number of guests will be limited to no more than ten at a time. The site is centrally located within the City of Paducah, giving guests easy access to shopping, dining and entertainment in the downtown area, southside and at the Regional Trade Center. The City of Paducah historic districts are nearby, affording guests a unique cultural view. Staff anticipates no more than three vehicles to be parked on the property at any one time. The site is approximately one mile from Noble Park, ½ mile from Carson Park and ¾ of a mile from Brooks Stadium, thereby providing outdoor recreational opportunities. The targeted demographics are nurses, contractors, insurance sales and families with children. Mr. Chapman seconded. No questions were asked. Planner III Josh Fowler-Sommer presented the staff report. He stated a short-term rental is a conditional use in the R-2 Zone. The house has two bedrooms, one full bathroom and one-half bath. The number of guests would be limited to no more than three at a time. The site is located centrally in Paducah. The Petitioner’s target demographic is nurses, quilters or new residents moving to Paducah. Parking would be one-street with one parking space in the back. Hearing no questions from the Board members, Chairwoman Young asked for the public hearing to be opened. Mr. Chapman offered: I move that this Board open the Public Hearing for case USE2025-0004 pertaining to 2429 Monroe Street. Vice-Chair Perry seconded. Chairwoman Young called for the vote. 4 Ayes (Boykin, Chapman, Perry, Young), 0 Nays Chairwoman Young invited the public to speak. No one spoke for the public hearing. Hearing no public comment, Chairwoman Young asked the public hearing to be closed. Mrs. Boykin offered: I move that this Board close the Public Hearing for case USE2025-0004 pertaining to 2429 Monroe Street. Mr. Chapman seconded. Chairwoman Young called for the vote. 4 Ayes (Boykin, Chapman, Perry, Young), 0 Nays Mr. Chapman offered: I move that this Board approve the conditional use request of John Watson for a short-term rental to be located in the R-2 Zone at 2429 Monroe Street. I further move that the approval be based on the following findings of fact: The site has convenient ingress and egress to Joe Clifton Drive, a minor arterial in this location. The site has convenient ingress and egress to Jackson Street and Park Avenue, both of which are major arterials. The number of guests will be limited to no more than three at a time. The site is centrally located within the City of Paducah, giving guests easy access to shopping, dining and entertainment in the downtown area, southside and at the Regional Trade Center.
