ORDINANCE NO. 98-7-5908
AN ORDINANCE AMENDING DIVISION 2, OF CHAPTER 66, OFFENSES
AND NIISCELLANEOUS PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY
OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Division 2, of the Code of Ordinances of the City of Paducah,
Kentucky, is hereby amended and reordained to read as follows:
"Prohibited Conduct on D o� Commercial Establishment Premises"
SECTION 2. That Section 66-77, Noise, is hereby amended to read as follows:
"Sec. 66-77. Noise.
It shall be unlawful for any person, while on or adjacent to the premises of a
row commercial establishment, to race the motor of any car, to suddenly start or stop any
car, or to make or cause to be made any other loud or unseemly noise. It shall also be unlawful for
any person parked on the premises of such r-estaumnt commercial establishment to blow or cause
to be blown any automobile horn or motorcycle horn at any time while so parked."
SECTION 3. That Section 66-78, Consumption or Possession of Alcoholic
Beverages Not Purchased on Premises, is hereby amended to read as follows:
"Sec. 66-78. Consumption or Possession of Alcoholic Beverages Not Purchased
on Premises.
It shall be unlawful for any patron or other person on the premises of a rem
commercial establishment, whether in or out of an automobile, to drink any beer or other
intoxicating liquor or to have in his possession any open bottle, can or other receptacle containing
beer or alcoholic beverages of any other type, nature or description, unless the same have been
purchased on the premises."
SECTION 4. That Section 66-79, Loitering, is hereby amended to read as
follows:
"Sec. 66-79. Loitering.
It shall be unlawful for a group of three or more persons to congregate and linger
at any location on the premises of a rem commercial establishment other than in the
Fob commercial building, or in a legally parked motor vehicle. Persons so congregating
and lingering shall be deemed guilty of loitering."
SECTION 5. That Section 66-80, Driving Onto and Leaving Premises Without
Parking, is hereby amended to read as follows:
"Sec. 66-80. Driving onto and leaving premises without parking.
No person shall drive a motor vehicle onto the premises of a r-estaumat
commercial establishment and then depart from the premises without parking the motor vehicle,
unless there is no unoccupied parking space available on the premises."

SECTION 6. That Section 66-81, Leaving Motor Vehicle in Parking Lot Without
Permission, is hereby amended to read as follows:
"Sec. 66-81. Leaving motor vehicle in parking lot without permission.
It shall be unlawful for any person to leave any unoccupied motor vehicle on any
r-e� commercial establishment's parking lot and to leave the premises thereof except with
the knowledge and consent of the operator of the roman commercial establishment."
SECTION 7. That Section 66-82, D o� Commercial Establishment to
Display Sign Warning of Prohibitions, is hereby amended to read as follows:
"Sec. 66-82. Restaufant Commercial establishment to display sign warning of
prohibitions.
It shall be the duty of each restftaA commercial establishment operator who
furnishes parking for patrons to post on the premises in a conspicuous location one or more signs
bearing the following legend:
Cruising in or congregating and lingering outside of a motor vehicle is unlawful.
No unoccupied vehicle may be left on these premises without the consent of the reser
commercial establishment operator."
SECTION 8. That Section 66-83, Cruising Prohibited, is hereby created to read
as follows:
(a) For the purpose of this section, the following terms shall be defined as
follows:
Congested TraIc -- Traffic on any street or driving aisle within a parking
_
lot serving, commercial establishments where a motor vehicle
cannot readily move forward because traffic speed is slowed to less
than ten (10) milers per hour and the delay in movement is due to
the position of the other motor vehicles.
Cruising -- The repetitive driving of any motor vehicle past a certain point
on a street or parking lot which is congested with traffic.
(b) No person shall engage in cruising, as herein defined, on any street or any
driving aisle of a parking lot serving a commercial development, which has
been posted as "No Cruising zone.
(c) A police officer may issue a written warning to apy person engaged in
cruising.
(d) Ay person who, after having received a written warning as aforesaid and
is observed to be cruising within four (4) hours after having received such
written warning, shall be deemed in violation of this section.
SECTION 9. That Section 66-83, Penalty, is hereby amended to read as follows:
"Sec. 66 83 66-84 Penalty.
Whoever violates any provision of this division for which another penalty is not
already otherwise provided shall be guilty of a misdemeanor and shall, upon conviction, be subject

effective upon publication in full pursuant to KRS Chapter 424.
