A MUNICIPAL ORDER ISSUING A FINAL DETERMINATION OF THE BOARD OF
COMMISSIONERS AS IT RELATES TO AN EMPLOYEE CONCERN PRESENTED BY
MATTHEW MEISER IN ACCORDANCE WITH CITY OF PADUCAH POLICY HR -43
WHEREAS, the City of Paducah has an administrative policy, HR -43, that sets forth the
procedures for an employee to bring forth an employment concern; and
WHEREAS, City Employee Matthew Meiser submitted a completed HR -43 form; and
WHEREAS, Mr. Meiser's concern was regarding the inclusion of notes from a
counseling session between an Employee and a supervisor where such counseling session is
typically the first step in the City's progressive discipline policy; and
WHEREAS, the Human Resources Director received the Employee Concern and after
due consideration found that the practice of including the aforementioned notes was both
appropriate and good practice; and
WHEREAS, Mr. Meiser, not finding satisfaction with the HR Director's determination,
appealed that decision to the City Manager; and
WHEREAS, the City Manager, after further review of the matter, found the HR
Director's determination to be appropriate and further found that it is in the best interest of both
the Employer and the Employee to retain documentation of any Counseling Session in the
Employee's personnel file in the HR Department; and
WHEREAS, Mr. Meiser, still not finding satisfaction at the level of the City Manager,
requested to appear before the Board of Commissioners; and
WHEREAS, Mr. Meiser presented his Employee Concern to the Board of
Commissioners and the Mayor and Commissioners have given the matter full and due
consideration.
NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KY:
SECTION 1. That the Human Resources Director and the City Manager appropriately
determined that documentation of an Employee's Counseling session should be kept in that
Employee's personnel file maintained by the Human Resources Department because doing so is
in the best interest of the Employee and the Employer. Failure to do so would result in
insufficient documentation of the Employee's corrective/disciplinary history, particularly if the
supervisor who conducted the Counseling Session was no longer employed by the City. Because
the first step in corrective/disciplinary process is counseling, the City must retain documentation
of all counseling in the Employee's personnel file so all future supervisors are aware of the
Employee's past corrective/disciplinary history and can take such information into consideration
in determining the next appropriate steps. Furthermore, the retention of this documentation in the
Employee's personnel file protects the Employee from a supervisor misremembering the details
of the Employee's Counseling Session, to the detriment of the Employee.
SECTION 2. That this determination is final.
SECTION 3. This Order shall be in full force and effect from and after the date of its
adoption.
