Chairman Wade called the regular meeting of the Paducah Planning Commission/ URCDA to order at 5:30 PM.
The Pledge of Allegiance was recited.
The roll was taken.
Commissioner Kaler offered:
I move that the reading of the minutes for September 7, 2023 be waived and that the minutes of said meeting, as prepared by staff, be approved as written.
Commissioner Rhodes seconded.
No corrections were requested. Chairman Wade called for the vote.

URCDA New Petitions
Case # INC2023-0019 610 Broadway
Upper Story Residential Grant.
Chairman Wade announced there was not a quorum for the URCDA to vote upon this item, as it appears Commissioner Griffin would be recusing himself. This item will be placed on the next
agenda.

Case # TXT2023-0001 Section 126-76 Sign regulations
Proposed text amendment to the sign code.
Mr. Sommer presented the staff report. He reviewed the highlights and described the case of City of Austin v. Reagan National Advertising. The B-2 Zone does not allow projecting signs,
but the B-2-T Zone does. The proposed text amendment would allow a seamless transition in the same areas of scale, massing and character. Guidance for murals is also proposed to be
introduced into the Zoning Ordinance.
Commissioner Rhodes asked what the driving factor for Austin case was. Mr. Sommer stated that Reagan National Advertising wished to convert some static billboards into electronic billboards.
This could not be done under Reed v. Gilbert. Therefore, Reagan National Advertising brought a suit against the City of Austin. Commissioner Rhodes asked if any sign companies were
wanting to construct signage in the City under the new Supreme Court Case. Mr. Sommer stated there were none, the text amendment was to bring the City into compliance with the Austin
case. Legal Counsel Paul Bradford stated our regulations have to comply with the Supreme Court case. This would be a content-neutral regulation.
Commissioner Rhodes asked if daylight savings time would affect the brightness of the sign. Planning Director Nic Hutchison stated it was to correlate with the noise ordinance. Discussion
was made about electronic message signs downtown. Further discussion was made about electronic message signs for places of worship. Mr. Hutchison stated that some churches would like
to upgrade their signage to electronic message signs. Mr. Sommer stated that churches in neighborhoods utilize signage to provide information to patrons. Mr. Hutchison stated this
was a standard approach to place of worship signs.
Commissioner Rhodes offered:
I move that this Commission adopt a resolution recommending to the Board of Commissioners that case TXT2023-0001 pertaining to the text amendment of 126-76 Sign regulations of the Paducah
Zoning Ordinance be adopted.
Commissioner Kaler seconded.
Chairman Wade then opened the public hearing.
No one from the public spoke.
Hearing no public comment, Chairman Wade closed the public hearing.
Commissioner Griffin asked about the enforcement of realtor signs. City Manager Daron Jordan stated that the Fire Prevention Division has been instructed to remove signs from the right-of-way.
Commissioner Rhodes asked if the City wanted more murals. Mr. Sommer stated the text amendment was to set parameters for murals. Discussion was made about murals in Marion, Illinois.
Mr. Sommer stated that any signage portion of a mural must conform to the underlying zone. The artistic portion can fill the entire façade. Murals in the historic zones would have
to receive approval from the HARC. Proposed murals on the public ROW would have to have approval from the Creative & Cultural Council. Discussion was made about specific items that
perhaps could be left of off murals. Mr. Bradford stated that would be a violation of the First Amendment. Discussion was made about examples of murals at different locations.
No further questions were asked. Chairman Wade called for the vote.

Case # TXT2023-0002 Section 126-83 Landscape regulations
Proposed text amendment to the landscape code.
Mr. Sommer presented the staff report. He stated single-family and two-family structures would now contain one tree per unit. One row of evergreen trees and fences would now be required
for various instances. Clear-cutting was discussed at length.
Staff did recommend the proposed text amendment be tabled. Mr. Sommer stated Mr. Jonathan Perkins, chairman of the Tree Board, had some changes to incorporate specifically for the size
of evergreen trees and the tree protection zone. Tabling the text amendment would give staff time to discuss, Mr. Bradford time to review and the public time to comment on the proposed
revisions.
Commissioner Griffin offered:
I move that this Commission adopt a resolution recommending to the Board of Commissioners that case TXT2023-0002 pertaining to the text amendment of 126-83 Landscape regulations of the
Paducah Zoning Ordinance be adopted.
Commissioner Kaler seconded.
Chairman Wade then opened the public hearing.

Commissioner Griffin made a motion to table TXT2023-0002 until the December 4th meeting.
Commissioner Rhodes seconded.
No further questions were asked. Chairman Wade called for the vote to table the text amendment.
