Box 2267 Paducah, KY 42002-2267 270-444-8522 or 270-444-8527 Case Number: PM2023-0105 Case Type: Property Maintenance Case Status: In Progress Date Case Established: 10/09/2023 Time Case Established: 12:00 AM Dear Property Owner: The City of Paducah, Kentucky, enforces the International Property Maintenance Code as adopted by Chapter 42 of City of Paducah Code of Ordinances. These codes are to protect the public health, safety and welfare on all existing premises by establishing minimum requirements and standards. This notice is being sent to inform you of the violations, your responsibilities, the penalties, and your rights. The violations detected are specifically as follows: Printed: 10/16/2023 PM2023-0105 Page 1 of 3 Violation: 304.2 PROTECTIVE TREATMENT All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints, as well as those between the building envelope and the perimeter of windows, doors and skylights, shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion, and all surfaces with rust or corrosion shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces designed for stabilization by oxidation are exempt from this requirement. Violation Identified: DILAPIDATED FASCIA Status: In Violation Resolved Date: Violation: 304.9 OVERHANG EXTENSIONS All overhang extensions including, but not limited to canopies, marquees, signs, metal awnings, fire escapes, standpipes and exhaust ducts shall be maintained in good repair and be properly anchored so as to be kept in a sound condition. When required, all exposed surfaces of metal or wood shall be protected from the elements and against decay or rust by periodic application of weather coating materials, such as paint or similar surface treatment. Violation Identified: OVERHANGS ARE DILAPIDATED NEEDS REPAIRS Status: In Violation Resolved Date: Violation: 602.2 RESIDENTIAL OCCUPANCIES Dwellings shall be provided with heating facilities capable of maintaining a room temperature of 68°F (20°C) in all habitable rooms, bathrooms and toilet rooms based on the winter outdoor design temperature for the locality indicated in Appendix D of the International Plumbing Code. Cooking appliances shall not be used, nor shall portable unvented fuel-burning space heaters be used, as a means to provide required heating. Exception: In areas where the average monthly temperature is above 30°F (-1°C), a minimum temperature of 65°F (18°C) shall be maintained. Violation Identified: PERMANENT HEAT SOURCE IS REQUIRED Status: In Violation Resolved Date: Printed: 10/16/2023 PM2023-0105 Page 2 of 3 Violation: 704.2 SMOKE ALARMS Single- or multiple-station smoke alarms shall be installed and maintained in Groups R-2, R-3, R-4 and in dwellings not regulated in Group R occupancies, regardless of occupant load at all of the following locations: 1. On the ceiling or wall outside of each separate sleeping area in the immediate vicinity of bedrooms. 2. In each room used for sleeping purposes. 3. In each story within a dwelling unit, including basements and cellars but not including crawl spaces and uninhabitable attics. In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than one full story below the upper level. Single- or multiple-station smoke alarms shall be installed in other groups in accordance with the International Fire Code. Violation Identified: SMOKE DETECTORS ARE REQUIRED Status: In Violation Resolved Date: It is your responsibility to obtain a permit from the Paducah Fire Department, Fire Prevention Division pursuant to PM-104.7 to (1) have all repairs, maintenance work, alterations or installations which are caused directly or indirectly by the noted violations to be executed and installed in a workmanlike manner pursuant to PM-102.5. or (2) have the premise razed and debris removed pursuant to PM-110.1 If you fail to comply with this notice in 60 days, the Fire Prevention Division may take appropriate actions and necessary steps to ensure the violations are corrected pursuant to Chapter 42-43 of the City of Paducah Code of Ordinances. Re-inspections may occur every 60 days and penalties for no action (Failure to Comply) are as follows: Initial (1st) Inspection – No Charge, 2nd Inspection – No Charge, 3rd Inspection - $250.00, 4th Inspection - $350.00, 5th and all subsequent follow-up Inspections: $500.00. A lien may be place against the property for all costs incurred plus interest pursuant to Section 42-44. You have the right to appeal this notice. A hearing by the Code Enforcement Board will be granted provided that within seven (7) days of date this notice was served, you have filed a written petition containing a request for such a hearing and a statement of the grounds pursuant to Sec. 42-40. You may submit your written petition to this office, Fire Prevention Division of the Paducah Fire Department. Furthermore, it shall be unlawful to sell, transfer, mortgage, lease or otherwise dispose of the premise to another until the violations have been corrected, or the receiving party has been informed of this Order and they fully accept the responsibility to make the corrections of this Order pursuant to PM-107.6. This office is interested in seeking compliance with this notice and the International Property Maintenance Code not in levying punishment. Our only intent is to provide a reasonable degree of safety for the citizens of Paducah.
