AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF
PROPERTY OF AUBURNDALE PADUCAH LIMITED PARTNERSHIP FOR PADUCAH
CENTER SUBDIVISION, LOCATED ON MCBRIDE LANE AND U. 5.60, ACCEPTING THE
DEDICATION OF STREETS AND PUBLIC EASEMENTS, AND SETTING BOND
AMOUNT
WHEREAS, the Paducah Planning Commission, at a meeting held on April 6,
1998, adopted as a preliminary report a plat of the proposed subdivision of property of
Auburndale Paducah Limited Partnership located on/at McBride Lane and U.S. 60, and by
Resolution dated June 15, 1998, recommended to the Board of Commissioners of the City of
Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision
reflected thereon, and accepting the dedication of streets and public easements shown thereon.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah Planning Commission on
June 15, 1998, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE
PADUCAH PLANNING COMM HSSION ON THE PROPOSED SUBDIVISION OF
.. PROPERTY OF AUBURNDALE PADUCAH LIMITED PARTNERSHIP FOR PADUCAH
CENTER SUBDIVISION LOCATED ON McBRIDE LANE AND U.S. 60", be approved as the
final report of said Commission respecting the matters set forth therein.
SECTION 2. That the subdivision of said property shall be, and it is hereby,
approved as shown on the plat referred to in said subdivision, which plat is entitled, "Paducah
Center Subdivision", and said property is hereby declared to be subdivided as shown on said plat.
SECTION 3. That the dedication of the public rights-of-way and public utility
easements shown on said plat shall be, and they are hereby, accepted by the City of Paducah, but
such acceptance shall not constitute an undertaking on the part of this Board or the City of
Paducah, Kentucky, for the construction or improvements of said right-of-way. The Mayor is
hereby authorized to subscribe a certificate of approval on the plat.
SECTION 4. That pursuant to Sec. 102-40(b)(2) of the Paducah Subdivision
Ordinance, an escrow agreement and supplemental letter of agreement dated June 3, 1998,
amending the escrow amount from $346,000 to $470,000, and running to the City of Paducah, is
set and that said escrow agreement shall be in such form and containing such contents that meet
the approval of the city engineer and the corporation counsel of the City of Paducah, and
authorizing the Mayor to execute said supplemental letter of agreement.
SECTION 5 That if any section, paragraph or provision of this ordinance shall be
found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such
section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make
each and every section, paragraph or provision hereof, it being the purpose and intent of this

other sections, paragraphs and provisions.
SECTION 6. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
