HomeMy WebLinkAbout98-9-594041 ORDINANCE NO. 98-9-4-D AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT 5187 HINKLEVILLE ROAD, FROM R-1, LOW DENSITY RESIDENTIAL ZONING, TO BBD, HIGHWAY BUSINESS DISTRICT ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on August 17, 1998, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT 5187 HINKLEVILLE ROAD AND OWNED BY OLIVET CHURCH CROSSING, L.L.C.," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is % hereby, changed from R-1, Low Density Residential Zoning, to BBD, Highway Business District Zone, and being more particularly described as follows: BEGINNING AT AN EXISITNG 1/2" REBAR LOCATED ON THE NORTH RIGHT-OF-WAY LINE OF U.S. 60, 83.57 FEET LEFT OF HIGHWAY CENTERLINE STATION 332+85.58 AND N. 720-09'-35" E. 85.59 FEET FROM AN EXISTING CONCRETE RIGHT-OF-WAY MONUMENT LOCATED AT THE INTERSECTION OF THE EAST RIGHT-OF-WAY LINE OF RELOCATED: OLIVET CHURCH ROAD AND THE NORTH RIGHT-OF- WAY LINE OF U.S. HIGHWAY 60,85 FEET LEFT OF U.S. HIGHWAY 60 CENTERLINE STATION 332+00 SAID 1/2" REBAR BEING AT THE SOUTHEAST CORNER OF THE PROPERTY CINVEYED TO EXPRESS LUBE, INC. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
