Sommer, Planner III Guests: Thomas Fairhurst, unidentified lady from Alameda Drive Chairwoman Young called the called meeting of the Paducah Board of Adjustment to order at 5:30 pm. The Pledge of Allegiance to the U.S. flag was recited. The roll was taken. Mrs. Boykin offered: I move that the minutes for March 25, 2024 be waived and that the minutes of said meeting be approved as written. Mr. Astin seconded. Chairwoman Young called for the vote. 5 Ayes (Astin, Boykin, Chapman, Perry, Young), 0 Nays Continued Petitions New Petitions Case# USE2024-0004 (A) 1505 North 12th Street Conditional Use request for a short-term rental in the R-3 Zone. Planner III Josh Sommer presented the staff report. He stated a short-term rental is a Conditional Use in the R-3 Zone. He further stated that the home is two bedrooms and one bathroom. The Petitioner would limit guests to no more than four. Parking would be off the alley. Mr. Astin offered: I move that this Board approve the conditional use request of Erika Calhoun for a short-term rental to be located in the R-3 Zone at 1505 North 12th Street. I further move that the approval be based on the following findings of fact: The site is one block from Cairo Road, a minor arterial. Cairo Road is an east-west thoroughfare with connections to Park Avenue/ Martin Luther King Jr. Drive and H.C. Mathis Drive. The number of guests will be limited to no more than four to prevent events and minimize wear and tear on the home. The site is located on the northside of the City of Paducah, giving guests easy access to shopping, dining and entertainment in both the downtown area and at the Regional Trade Center. The site is located in the Northside Historic District, thereby giving guests an opportunity to enjoy architectural and cultural features in the neighborhood. The other City of Paducah historic districts are nearby, affording guests a unique cultural view. The number of vehicles, which staff estimates will be limited to two, will park in the driveway off the alley. There is also on-street parking available if needed. Outdoor recreational opportunities exist at the nearby Greenway Trail and Noble Park. Vice-Chair Perry seconded. Chairwoman Young opened the public hearing and invited the Petitioner to speak. Hearing no public comment, Chairwoman Young closed the public hearing. No questions were asked. Chairwoman Young called for the vote. 5 Ayes (Astin, Boykin, Chapman, Perry, Young), 0 Nays Case# USE2024-0004 (B) 3810 Alameda Drive Conditional Use request for a short-term rental in the R-2 Zone. Planner III Josh Sommer presented the staff report. He stated a short-term rental is a Conditional Use in the R-3 Zone. He further stated that the home is three bedrooms and two bathrooms. The Petitioner would limit guests to no more than five. Parking would be in the driveway off Alameda Drive. Vice-Chair Perry offered: I move that this Board approve the conditional use request of Erika Calhoun for a short-term rental to be located in the R-2 Zone at 3810 Alameda Drive. I further move that the approval be based on the following findings of fact: The site is 120 feet from Friedman Lane, a major collector street. Friedman Lane is a north-south thoroughfare with connections to Pines Road and Hinkleville Road. The number of guests will be limited to no more than five to prevent events and minimize wear and tear on the home. The site is located in the West End of the City of Paducah, giving guests easy access to shopping, dining and entertainment in the downtown area, Midtown and at the Regional Trade Center. The City of Paducah historic districts are nearby, affording guests a unique cultural view. The number of vehicles, which staff estimates will be limited to three maximum, will park in the driveway off Alameda Drive. There is also on-street parking available if needed. Chairwoman Young called for the vote. 5 Ayes (Astin, Boykin, Chapman, Perry, Young), 0 Nays Case# VAR2024-0010 421 Flora Avenue Side yard variance request of one foot on each side to allow a single-family home to be constructed five feet from the east and west property lines. Planner III Josh Sommer presented the staff report. He stated a single-family home used to be located on the lot, which was razed about 2010. He further stated the lot in question is a non-conforming lot as it is not 8,000 square feet, nor has 50’ of frontage. The proposal is for a 747 square foot home. Mr. Sommer stated the floor plan and renderings are in the packets. He further stated the variance would be comply with the Comprehensive Plan. He further stated the Petitioner lived in Louisville and could not attend. Mr. Chapman offered: I move that this Board approve the petition of Shadrack Mundanda for a one-foot variance one each side for a single-family home to be constructed five feet from the east and west property lines at 421 Flora Avenue. I further move that the variance be approved based on the following findings of fact: The subdivision was platted before the adoption of the present zoning ordinance. The lot is legally nonconforming to the prescribed width and area requirements of the R-3 Zone. The City of Paducah Comprehensive Plan supports population growth and housing choice. This location is in the larger Southside redevelopment area. The construction of a new quality home would help to further the City’s success in this area. The construction of this home in line with the existing homes to the east and west helps to re-create the historic viewshed and street wall. This lot is a legal nonconforming lot. Therefore, the granting of this variance would help to further an opportunity that may not have immediately appeared. Vice-Chair Perry seconded. Chairwoman Young opened the public hearing and invited the public to speak. Mr. Thomas Fairhurst, 409 Flora Avenue, spoke. He stated in order for new homes to be constructed lots were being sold two at a time. He felt the Petitioner was trying to save money instead of buying two lots. Mr. Sommer stated it was commonplace for the BOA to approve variances on 40’ lots, as had been done in the past. Chairwoman Young asked if the home would be manufactured or stick-built. Mr. Astin stated it appeared to be stick-built based on the submitted proposal. Mr. Chapman asked if he would live there. Mr. Sommer stated the Petitioner would be moving here from Louisville. Vice-Chair Perry asked if the home would be on a permanent foundation. Mr. Sommer stated that was correct. Hearing no further comment, Chairwoman Young closed the public hearing. No further questions were asked. Chairwoman Young called for the vote. 5 Ayes (Astin, Boykin, Chapman, Perry, Young), 0 Nays Other Business Adjournment The BOA adjourned at 5:50 pm.
