AN ORDINANCE AMENDING SEC. 66-83 OF CHAPTER 66, ARTICLE III,
OFFENSES AGAINST PUBLIC PEACE AND SAFETY, DIVISION 2, PROHIBITED
CONDUCT ON COMMERCIAL ESTABLISHMENT PREMISES, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Sec. 66-83, "Cruising Prohibited", of Article III, "Offenses
Against Public Peace and Safety", of Chapter 66, "Offenses and Miscellaneous Provisions", of the
Code of Ordinances of the City of Paducah, Kentucky is hereby amended and reordained to read as
follows:
"Sec. 66-83. Cruising prohibited.
(a) For the purpose of this section, the following terms shall be defined as
follows:
Congested traffic: Traffic on any street or driving aisle within a parking lot
serving commercial establishments where a motor vehicle cannot readily move
forward because traffic speed is slowed to less than ten miles per hour and the
delay in movement is due to the position of the other motor vehicles.
Cruising: The repetitive driving of any motor vehicle past a certain point on a
street or parking lot which is congested with traffic more than once in anv four
hour period. The passing of a certain point on a street or parkin lot a third time
under the aforesaid conditions shall constitute unnecessary repetitive driving and
therefore a violation of this ordinance.
(b) No person shall engage in cruising, as herein defined, on any street or any
driving aisle of a parking lot serving a commercial development, which has been
posted as "No Cruising" zone. For purposes of this ordinance, the person having
control and/or ownership of a motor vehicle shall be considered the person
cruising, without regard as to whether that person was actually driving the motor
vehicle each time it passed the traffic control point. Having control or ownership
of a motor vehicle shall mean either the owner of the vehicle as stated on the
vehicle registration if present in the vehicle at the time of the violation, or, if the
owner is not present in the vehicle, the person operating the vehicle at the time of
the violation of this ordinance.
(c)

ambulance, or other governmental vehicle when same is being operated in an
official capacity. In addition, this ordinance shall not apply to any duly licensed
public transportation vehicle nor to any vehicle utilized for business and/or
commercial purposes."

SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
