AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTIES
LOCATED AT 1335 BURNETT STREET AND 1401 PARK AVENUE, FROM R-3, MEDIUM
DENSITY RESIDENTIAL ZONE TO B-3, GENERAL BUSINESS ZONE, AND AMENDING
THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution passed by the Paducah Planning Commission on
June 21, 1999, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF
THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR
PROPERTIES LOCATED AT 1335 BURNETT STREET AND 1401 PARK AVENUE," be
approved as the final report of said Commission respecting the matters therein set forth.
SECTION 2. That the zone classification and the map amendment proposed in
said resolution be, and the same are hereby, declared to be in agreement with the comprehensive
plan of the City of Paducah.
SECTION 3. That the zone classification of the following described property be,
and it is hereby, changed from R-3, Medium Density Residential Zone to B-3, General Business
Zone:
Beginning at a point in the centerline of North 14th Street; said point being
230' northwest of the intersection of the centerlines of North 14th Street
and Burnett Street; in a northerly direction from said starting point a
distance of 215' to a point in the centerline of a 20' alley; thence in an
easterly direction with centerline of said alley a distance 230' to a point,
said point being centerline of Burnett Street; thence in a southerly direction
with centerline of Burnett Street a distance of 215' to a point, said point
being the intersection of Burnett Street and North 14th Street; thence in an
easterly direction +-225' to a point, said point being the intersection of
North 14th Street and Park Avenue; thence in a westerly direction +-390'
to a point, said point being the intersection of Park Ave and Burnett Street;
thence in a northerly direction +-320' to a point, said point being the
intersection of North 14th Street and Burnett Street; thence in an easterly
direction 230' to the point of beginning.
SECTION 4. That the proposed Development Plan is accepted and is hereby
adopted according to the specifications of Section 126-176 of the Paducah Zoning Ordinance
with the following standards:
A) The final development plan to be approved by the City of Paducah in
compliance with all ordinances before issuance of building permit.
B) A landscape screen plan to be submitted to the Department of Planning with
the final development plan.
C) All exterior lighting shall be directed inward on the subject property.
D) Signs - One (1) free standing sign will be permitted. Sign face maximum will
be 25 SF per sign face. Maximum sign height of six (6) feet.

E) A stormwater management plan, if applicable, shall be approved in conjunction
with final development plan.
F) Permitted land uses - The following uses are approved as components of the
Hope Unlimited Pregnancy Center: administrative offices and meeting areas,
retail sales, a clinic for medical services, and a counseling center.
G) Substantial construction shall be initiated within one year following the
enactment of the map amendment.
SECTION 5. That if any section, paragraph or provision of this ordinance shall be
found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such
section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it
being the purpose and intent of this ordinance to make each and every section, paragraph and
provision hereof separable from all other sections, paragraphs and provisions.
SECTION 6 This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
