CITY CLERK Attendees: Melinda Winchester, Amanda Johnson, Heather Coltharp, Chris Jones Absent: Staff: Palmer Stroup -Planner I Guests: Richard Glasscock -Applicant, Cath! Harrison -Applicant, Char and Jay Downs- Public Commissioner Jones called the called meeting of the HARC to order at 5:30 pm. APPROVAL OF MINUTES Commissioner Winchester offered the following Motion: I move that the reading of the minutes for June iz, 2023 meeting be waived and that the minutes of said meeting, prepared by Planning Staff, be approved as written. Commissioner Johnson provided a second. The motion passed with 4 Ayes (Winchester, Johnson, Jones, Coltharp) o Nays New Cases Case #COA2023-000 Applicant: Richard Glasscock Address: 722 Harrison Street Zone H-2 Request for Certificate of Appropriateness Planning Staff presented the staff report. At the end of the presentation the applicant Richard Glasscock requested an additional variance to be added to the agenda and approved by the HARC allowing him to place the proposed garage closer to the neighboring property line. Commissioner Jones made a motion to table the discussion of a variance to the next HARC meeting. The Motion was seconded by Commissioner Coltharp and adopted with 4 Ayes (Winchester, Jones, Coltharp, Johnson) and o Nays. Commissioner Winchester made the following motion: I move that this Commission Approve the Certificate of Appropriateness request of Richard Glasscock for the construction of a new garage in the rear yard Of 722 Harrison Street. I further move that the approval be based on the following findings of fact • The proposed garage location is in conformity with the zoning requirements for rearyard and side yard setbacks. • The proposed garage is intended to match and complement its primary home in materials and appearance. • The proposed garage is in conformity and complies with a majority of the H -z Lowertown Design Standards The Motion was seconded by Commissioner Johnson and adopted with 4 Ayes (Winchester, Jones, Coltharp, Johnson) and 0 Nays. Harrison Address: 133 Market House Square Zone NSZ Request for Certificate of Appropriateness Planning Staff presented the staff report. The HARC had no further recommendations. Commissioner Johnson made the following motion: I move that this Commission Approve the Certificate of Appropriateness request of Cathi Harrison for the placement of two projecting signs at 133 Market House Square I further move that the approval be based on the following findings of fact • The proposed signs will be revised and shortened in size to not exceed a total area of six square feet. • The placement of two signs is permitted by the zoning code due the property's location on a corner and resulting two facades • The proposed materials are permitted by the zoning ordinance and H-1 design standards. The Motion was seconded by Commissioner Winchester and adopted with 4Ayes (Winchester, Jones, Coltharp, Johnson) and o Nays. Violation Notice Property Owner: David Guess Address: 302 N. 7th Street Zone H-2 Planning Staff read the violation letter pertaining to 302 N. 7th Street. This letter which was previously sent to the property owner detailed the following: • The Planning Department and HARC have been notified that several mini split air units have been installed on the exterior of the property at 302 N. 7th Street. • These air units were installed without HARC approval. • The property owner David Guess is requested to attend the scheduled HARC hearing to discuss the violation. David Guess was not present at the HARC meeting. After the reading of the letter the HARC discussed the violation further. They determined the following findings of fact to detail how the property is in violation of the Paducah Zoning Code and Design Standards for the H-2 Zone. • Sec. 126-115 (g) of the Paducah Zoning Ordinance states that for exterior changes in appearance to a structure in a local historic district (H-2 Zone) approval from the HARC with a Certificate of Appropriateness is required. • The air units located on the exterior of 302 N. 7th Street were placed without HARC approval and were not granted a Certificate of Appropriateness. • The H-2 Design Standards requires the placement of utility systems to not be visible from the roadway. The air units at 302 N. 7th Street are visible from both 7th Street and Monroe. Because of the violation the HARC recommends for all visible air units located at the front of the house facing 7th Street and on the side facing Monroe to be removed from the property or moved to a location not visible from the roadway. After determining the violation with the preceding findings of fact, the floor was opened to public comment. The comments made were: MINUTES OF THE HISTORIC AND ARCHITECTURAL REVIEW COMMISSION—continued page 3 13 • The property owner David Guess needed to follow the HARC approval process. • The violation at 302 N. 7'h sets a bad precedent and example for the exterior work allowed in the Lowertown neighborhood. Adjournment After the close of public comment Commissioner Jones made a motion to adjourn the meeting. Commissioner Johnson provided a second. The motion passed with 4 Ayes (Winchester, Jones, Coltharp, Johnson) o Nays The meeting was adjourned at 6:40 PM Respectfully submitted by Palmer Stroup
