Chairwoman Young called the regular meeting of the Paducah Board of Adjustment to order at 5:30 pm.
The Pledge of Allegiance to the U.S. flag was recited.
The roll was taken.
Mrs. Boykin offered:
I move that the reading of the minutes for June 26, 2023 be waived and that the minutes of said meeting,
as prepared by staff, be approved as written.
Mr. Astin seconded.
No corrections were requested. Chairwoman Young called for the vote.

Case# USE2023-0003 2638 Clark Street
Short-term rental in an accessory dwelling unit.
Mr. Sommer presented the staff report. He stated the proposal was for a short-term rental in an accessory
structure. A 576 square foot garage is proposed to be remodeled into a one -bedroom apartment. The
Petitioner would like to market the STR toward traveling nurses since the structure is in the proximity of
Baptist Health Hospital.
Vice -Chair Perry offered:
I move that this Board approve the conditional use request of David Carrozzo for a short-term rental to
be located inside an accessory dwelling unit at 2638 Clark Street.
I further move that the approval be based on the following findings offact:
1. The Paducah Tilghman High School campus is located nearby, thereby minimizing the number of
homes impacted.
2. The Baptist Health hospital is located nearby, thereby minimizing the number of homes impacted

3. Only one row of houses is between the site and a church which takes up half of the northern part
of the block south of the site.
4. The site has convenient ingress and egress to Jackson Street and to Washington Street/ Kentucky
Avenue, both of which are major arterials.
5. There will be sufficient area for off-street parking in the driveway.
6. The Petitioner wishes to assist nurses and other health care professionals by providing this unit
close to Baptist Health hospital.
7. The City of Paducah Comprehensive Plan supports population growth and housing choice.
8. Housing choice is a City Commission priority.
Mr. Astin seconded.
Chairwoman Young opened the public hearing and invited the Petitioner to speak.
Mr. Cameron Carrozza spoke. He stated the access would be off the alley for the new unit. The driveway
would be extended to the alley. He also asked what the address would be. Mr. Sommer will e-mail the
address to Janet Dicke in Fire Prevention for an address.
Mrs. Boykin asked if the other unit would have to come before the BOA. Planning Director Nic Hutchison
stated it would not have to as it would be a standard rental.
No further questions were asked. Chairwoman Young closed the public hearing and called for the vote.

Case# VAR2023-0009 129 Fountain Avenue
Side yard setback of 17' to allow a single-family home to be constructed eight feet from the west property
line.
Mr. Sommer presented the staff report. He stated the proposal was for a new single-family structure to be
constructed eight feet from the west property line. The new home is proposed to be approximately 1,720
square feet. A garage is a possible option. Mr. Sommer stated the lot is nonconforming with respect to
the R-1 Zone in lot width and size. Mr. Sommer stated the previous home on the lot sat closer to the west
property line than 25'. Staff is recommending approval based on the nonconforming status of the lot, the
turning movements of vehicles from Jefferson Street onto Fountain Avenue and the Comprehensive Plan.
Mr. Astin offered:
I move that this Board receive and file the application of Fred & Martha Vowell for a 17 foot side yard
variance request for a proposed single-family home to be constructed eight feet from the west property
line.
I further move that the variance be approved based on the following findings offact
1. The City of Paducah Comprehensive Plan supports population growth and housing choice.
2. Housing choice is a City Commission priority.
3. The proposed home is of the same general size and character as the surrounding existing homes.

4. The home across Jefferson Street at 201 Fountain Avenue is located approximately 7.5 feet from
the side property line.
5. Traffic speeds are low on this corner, as the intersection is a four-way stop and traffic must turn
onto Fountain Avenue from Jefferson Street.
6. The previous home on the lot was closer than 25' to the side property line.
7. This location is on a prominent corner, thereby a more prominent ornate home should be located
thereon.
8. The lot is nonconforming with respect to the area and width requirements of the R-1 Low Density
Residential Zone.
Vice -Chair Perry seconded.
Chairwoman Young opened the public hearing and invited the Petitioner to speak.
Ms. Heather Pierce, representative for the Petitioner, stated that a contract had been proposed since
submitting the eight -foot variance request. She stated the proposal is for seven feet instead of eight. Mr.
Sommer asked if the proposed additional variance would be both sides or just the Jefferson Street side.
Ms. Pierce stated it was just for the Jefferson Street side. Mr. Sommer stated that based on the home at
201 Fountain Avenue being 7.5 feet off the property line and the turning movements at Jefferson Street,
the additional one -foot variance could be granted. Mr. Hutchison asked what the existing setbacks of the
next-door house were. Mr. Fred Vowell, Petitioner, stated the house was about five or six feet off the
property line.
Mr. Astin made a motion to amend the motion on the floor as follows:
I move that this Board receive and file the application of Fred & Martha Vowell for an 18 foot side yard
variance request for a proposed single-family home to be constructed seven feet from the west property
line.
Mrs. Boykin seconded.
Chairwoman Young closed the public hearing and called for the vote on the amendment.
