ORDINANCE NO. 2000-10- ( 7
AN ORDINANCE PROVIDING FOR THE CLOSING OF A
PORTION OF AN ALLEY LOCATED BETWEEN SOUTH
SECOND STREET, SOUTH THIRD STREET, TENNESSEE
STREET AND OHIO STREET
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah does hereby authorize the closing
of a portion of an alley located between South Second Street, South Third Street,
Tennessee Street and Ohio Street, and being more particularly described as follows:
A certain tract of land surveyed by the Ricky A. Tosh, PLS N.
2900, of the firm of Dummer Surveying & Engineering services,
Inc. of Paducah, Kentucky on March 2, 2000 located on the
south side of Ohio Street in the City of Paducah, McCracken
County, Kentucky and being more particularly described as
follows:
Beginning at 1/2" diameter rebar with cap 33 feet south at right
angles from the centerline of Ohio Street, Said centerline point
being 166.00 feet east with said centerline from the centerline
intersection of Ohio Street and 3'd Street;
Thence south 23 degrees 08 minutes 12 seconds east for a
distance of 289.50 feet with the east line of the James Hamilton
Warner and William Keith Warner properties described in Deed
Book 705, Page 602, Deed Book 934, Page 233, Deed Book
808, Page 291 and Deed Book 891, Page 797 to a'/z" diameter
rebar with cap set in a common corner to the Mountaineer Realty
Company property described in Deed Book 518, Page 644;
Thence north 66 degrees 52 minutes 05 seconds east for a
distance of 25.50 feet severing the alley to a'/2" diameter rebar
with cap in the west line of the James Warner and Keith Warner
property, d/b/a Warner's Radiator Repair, described in Deed
Book 832, Page 479;
Thence North 23 degrees 08 minutes 12 seconds west for a
distance of 289.50 feet to a'/2" diameter rebar with cap 33 feet
with the west line of said property to a'/2" diameter rebar with
cap 33 feet south at right angles from the centerline of Ohio
Street;
Thence south 66 degrees 52 minutes 05 seconds west for a
distance of 25.50 feet with the south line of Ohio Street to the
point of beginning.
Said property contains 0.1695 acres.
SECTION 2. The Corporation Counsel of the City of Paducah,
Kentucky, is hereby authorized, empowered and directed to institute and
prosecute, pursuant to KRS 82.405, an action in the McCracken Circuit Court
for a judgment ordering the closing of the alley described in Section 1 above.

SECTION 3. This ordinance shall be read on two separate days
and will become effective upon summary publication pursuant to KRS Chapter
424.
