HomeMy WebLinkAbout2000-10-6276629 ORDINANCE NO. 2000-10- c (-7tl, AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR PROPERTIES LOCATED AT 2235 IRVIN COBB DRIVE, FROM B-3, GENERAL BUSINESS ZONE TO r M-1, LIGHT INDUSTRIAL ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on September 18, 2000, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR PROPERTIES LOCATED AT 2235 IRVIN COBB DRIVE," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from B-3, General Business Zone to M-1, Light Industrial Zone: Beginning at a corner to the existing M-1 (Light Industry Zone) lying at the intersection of Bridge Street with Irvin Cobb Drive and the Easterly right-of-way line, projected Northwardly, of the Illinois Central Railroad Tipple Track; THENCE FROM SAID POINT OF BEGINNING Southwardly with a curve to the left having a radius of 904.94 feet in said Easterly right-of-way line, projected Northwardly, and the Easterly right-of-way line of said Illinois Central Railroad Tipple Track approximately 983 feet to a point opposite and 100 feet Northeastwardly therefrom the Southeast comer of the Mid -Western Commercial Roofers, Inc. property recorded in Deed Book 732, Page 549; thence Southwestwardly and tangent to the centerline of said Illinois Central Railroad Tipple Track 100 feet to a point at the Southeast corner of said Mid-Westem Commercial Roofers, Inc. property, said point also being at the intersection of the Westerly right-of-way line of aforesaid Illinois Central Railroad Tipple Track with the Northerly right-of-way line of the Illinois Central Railroad Main Track; thence N 650 20' 56" W with the Southerly line of said Mid -Western Commercial Roofers, Inc. property and the Northerly right-of-way line of said Illinois Central Railroad Main Track 564.38 feet to a point at the Southwest corner of said Mid - Western Commercial Roofers, Inc. property and in the centerline, projected Southwestwardly, of Cross Creek; thence Northwardly with the Westerly line of said Mid-Westem Commercial Roofers, Inc. property and with the centerline, projected Southwestwardly, and the centerline meanders of said Cross Creek for the following 3 calls: N 13° 29'55" E, 145.98 feet to a point; N 33° 57,29" W, 87.56 feet to a point; and N 11 ° 51' 16" W, 93.69 feet to a point; thence Westwardly and Northeastwardly with the Westerly line of aforesaid Mid - Western Commercial Roofers, Inc. property and the approximate centerline of said Cross Creek prior to Channel Change performed by Kentucky Department of Transportation for the following 5 calls: S 790 24'02" W, 55.74 feet to a point; N 310 39'40" W, 24.41 feet to a point; N 200 04'35" E, 35.06 feet to a point; N 480 59' 17" E, 55.46 feet to a point; and N 68° 37'44" E, 36.45 feet to a point in the Southerly right-of-way line of aforesaid Irvin Cobb Drive; thence with said Southerly right-of-way line for the following 3 calls: S 260 09'00" E, 20.00 feet to a point; N 620 39'26" E, 55.24 feet to a point; and N 290 14'00" W, 43.00 feet to a point; thence N 290 14'00" W approximately 39.5 feet to a point in the centerline of aforesaid Irvin Cobb Drive; thence Northeastwardly with said centerline approximately 494 feet to the point of beginning as shown on "Preliminary Development Plan for Mid-Westem Commercial Roofers, Inc." prepared by Hunter Martin & Associates, Inc. dated August 7, 2000. 630 The above legal description was written by Rod H. Martin, Kentucky Licensed Professional Land Surveyor, on the 25h day of August. 2000, and is correct to the best of my knowledge and belief. SECTION 4. "that if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and i provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
