EXECUTIVE SESSION August 23, 2022 At a Regular Meeting of the Paducah Board of Commissioners held on Tuesday, August 23, 2022, at 5:00 p.m., in the Commission Chambers of City Hall located at 300 South 5th Street, Mayor George Bray presided. Upon call of the roll by the City Clerk, Lindsay Parish, the following answered to their names: Commissioners Guess, Henderson, Wilson and Mayor Bray (4). Commissioner Gault was not present at the meeting. INVOCATION Commissioner Wilson led the invocation. PLEDGE OF ALLEGIANCE Mayor Bray led the pledge. PUBLIC HEARING Communications Manager Pam Spencer provided the following: "A public hearing was held at the beginning of the meeting as part of the requirement for the Community Development Block Grant application on behalf of the Paducah - McCracken County Senior Center. The Senior Center is planning to build an estimated $4.3 million, 7000 square foot facility at 1600 Kentucky Avenue. The grant request is for $1.5 million." No public comments were made. NEW EMPLOYEE INTRODUCTION Finance Director Jonathan Perkins introduced Revenue Tech Anayeli Arrelaino-Tapia. MAYOR'S REMARKS Communications Manager Pam Spencer provided the following summary: City Block Project Update "Mayor George Bray announced that last week he met with representatives of Weyland Ventures in Louisville to discuss the timeline for the City Block project. City Manager Daron Jordan and City Commissioner Raynarldo Henderson also attended the meeting. Mayor Bray said that the meeting went well, and that the groundbreaking for the project is getting closer. Weyland has been working with the project contractors to coordinate the launch of the project construction and hopes to finalize a timeline soon." MUNICIPAL ORDERS APPROVE ACCEPTANCE OF 2019 BUILD GRANT FOR $10AM August 23, 2022 Commissioner Henderson offered Motion, seconded by Commissioner Wilson, that the Board of Commissioners adopt a Municipal Order entitled, "A MUNICIPAL ORDER ACCEPTING GRANT FUNDS THROUGH THE U.S DEPARTMENT OF TRANSPORTATION MARITIME ADMINISTRATION (MARAD) FOR A BETTER UTILIZING INVESTMENTS TO LEVERAGE DEVELOPMENT (BUILD) GRANT IN AN AMOUNT OF $10,400,000 TO IMPROVE THE PADUCAH RIVERFRONT AND PEDESTRIAN CORRIDOR FROM THE CONVENTION CENTER TO DOWNTOWN, AND AUTHORIZING THE MAYOR TO EXECUTE THE GRANT AGREEMENT AND ALL DOCUMENTS RELATED TO SAME. (MO #2633; BK 12) ORDINANCE ADOPTION(S) BUDGET AMENDMENT FOR FUND BALANCE TRANSFER FOR VEHICLE PURCHASES Commissioner Guess offered Motion, seconded by Commissioner Henderson, that the Board of Commissioners adopt an Ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 2022-06-8740, ENTITLED, "AN ORDINANCE ADOPTING THE CITY OF PADUCAH, KENTUCKY, ANNUAL OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2022, THROUGH JUNE 30, 2023, BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS FOR THE OPERATION OF CITY GOVERNMENT." (ORD 2022-08-8746; BK 36) ORDINANCE INTRODUCTIONS) CLOSURE OF AN ALLEY — GEORGE STREET, SOUTH 3p -]D STREE AND SOUTH 4TH STREET August 23, 2022 Commissioner Wilson offered Motion, seconded by Commissioner Henderson, that the Board of Commissioners introduce an Ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CLOSING OF A 3,528.36 SQUARE FOOT ALLEY NORTH OF GEORGE STREET AND BETWEEN SOUTH 3RDSTREET AND SOUTH 4d' STREET, THE CLOSURE OF A 1,004 SQUARE FOOT ALLEY SOUTH OF HUSBAND STREET BETWEEN SOUTH 3RD STREET AND SOUTH 4THSTREET AND THE CLOSURE OF A PORTION OF 1,103.73 LINEAR FEET OF THE WEST SIDE OF SOUTH 4THSTREET; AND AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS RELATING TO SAME. INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY; THE COUNTY OF McCRACKEN, KENTUCKY; AND THE SPORTS TOURISM COMMISSIONER — PADUCAH-McCRACKEN COUNTY ATHLETIC COMPLEX Commissioner Wilson offered Motion, seconded by Commissioner Henderson, that the Board of Commissioners introduce an Ordinance entitled, ""AN ORDINANCE OF THE CITY OF PADUCAH, KENTUCKY, APPROVING AN INTERLOCAL COOPERATION AGREEMENT AMONG THE COUNTY OF McCRACKEN, KENTUCKY, THE CITY OF PADUCAH, KENTUCKY, AND THE McCRACKEN COUNTY SPORTS TOURISM COMMISSION FOR THE DEVELOPMENT AND OPERATION OF THE PADUCAH-McCRACKEN COUNTY ATHLETIC COMPLEX, AND AUTHORIZING THE MAYOR OF THE CITY OF PADUCAH TO EXECUTE AND DELIVER SAID AGREEMENT AND ALL LEGAL DOCUMENTS RELATED THERETO, AND TO TAKE ALL SUCH FURTHER ACTIONS ON BEHALF OF THE CITY DEEMED REASONABLE AND NECESSARY IN ORDER TO CARRY OUT THE TERMS AND CONDITIONS OF SAID AGREEMENT." DISCUSSION Communications Manager Pam Spencer provided the following summary Commission Priorities Quarterly Update Assistant City Manager Michelle Smolen updated the Board on the progress of the 10 priorities that were adopted following the February strategic planning retreat. The 10 priority items are listed below in no particular order: • 911 Radio/Tower Upgrades and Operational Funding • Minority Inclusion • Downtown • Southside Enhancements • Housing • Beautification • Community Growth August 23, 2022 • Trails and Bike Paths Enhancements • Continue Efforts to Improve Operational Efficiencies • Protecting Key Historical and Cultural Resources The list of City Commission Priorities also includes three continuous improvements action items: stormwater, city facilities, and the outdoor sports complex. COMMENTS Citv Manager Comments • Thanked Michelle Smolen, Assistant City Manager for her work on several projects • Asked City Clerk Lindsay Parish to give a report on the Job Fair that was held today. Lindsay reported that the City participated with four booths. Over 100 employers were represented and 352 job seekers came through the event. • Reported that he was informed that Southside Paducah project will receive a KLC Award during their conference. • The City has an opportunity to apply for a Federal Grant to improve the area around the Coke Plant at Lone Oak Road and Broadway. The request for application will be on the September 13 meeting agenda. Public Comments J. W. Cleary commented on his appreciation of the leadership of our Mayor and Commission, and all the positive things that are happening in Paducah. The Company hereby understands and accepts that the economic incentive payment shall be based upon the following conditions: • Economic Incentive is based on a job target, over base employment number of 288, of forty (40) new full-time employees by December 31, 2026 • Economic Incentive is based on maintaining, or exceeding, said job target for a period of five (5) years commencing on December 31, 2026 and culminating on December 31, 2031 • No later than January 15, 2027, and on January 15 of each year subsequent to 2027, and through January 2032, ViWinTech shall submit to the City of Paducah's Finance Department an accounting of all full-time employees currently in the employment of ViWintech so as to affirm that the base number of employees has increased in accordance to the terms of this agreement • Economic Incentive shall be repaid to the City of Paducah, KY no later than January 30, 2032, based on a prorated schedule, as attached hereto and made part hereof (Schedule A), should job target numbers not be met in accordance with above conditions as agreed upon by both parties. SECTION 2: TERMINATION. Either party may terminate this MOU upon failure of any party to comply with any provision of this agreement provided any such party notifies the other in writing of such failure and the breaching party fails to correct the breach within thirty (30) calendar days of the notice. PERKINS Category: Ordinance Staff Work By: Jonathan Perkins Presentation By: Jonathan Perkins Background Information: Real estate and personal property tax levies for the City's General Fund and Paducah Junior College (PJC) are proposed to be set as per the attached ordinance. The City's General Fund real estate tax levy is proposed to be $.265 per $100 assessed value (AV). The proposed FY2023 rate is 61% of what the rate was in FYI 995, when the City started a conscious effort to lower real estate tax rates. The City's General Fund personal tax levy is proposed to be $.390 per $100 AV. The proposed FY2023 rate is 23% less than the FY1995 rate. The City eliminated inventory taxes many years ago in order to encourage inventory -rich business growth in Paducah. The City's inventory rate was phased out over a four-year period, 1998 through 2002, and fully eliminated in FY2003. The inventory tax would have netted revenue nearly $819,000 in FY2023, if it were in place today. Staff proposes the City's tax levy be set at 26.5 cents per $100 AV. The FY2023 compensating rate is 25.5 cents per $100 AV and Kentucky Revised Statutes (KRS) permits a city to adjust the compensating rate upward by not more than 4%, in this case to 26.5 cents. From FY2001 to FY2023, the City of Paducah has lowered its real estate tax levy by 3.5 cents, while others increased their tax levy during the same time period. The property tax levy ordinance will be introduced on September 13, 2022 with the second and final reading on September 27, 2022. Since the City's proposed tax levy is more than the `compensating rate' of 25.5 cents per $100 AV, a public hearing is required; a public hearing is scheduled for September 13, 2022.
