MINUTES OF THE PADUCAH PLANNING COMMISSION
MARCH 15, 2021 5:30 P.M.
Video Conference Meeting via Zoom
Note: In order to keep the Commission and public safe in the midst of the COVID-19 outbreak this
meeting was held virtually using video teleconferencing. In accordance with Senate Bill 150, the
public was invited to participate by joining:

Attendees: Chairwoman Cathy Crecelius, Vice-Chair Lorraine Schramke, Joe Benberry, David
Morrison, Valerie Pollard, Bob Wade

Chairwoman Crecelius called the regularly-scheduled meeting of the Paducah Planning Commission
to order at 5:30 pm. Members who were present were visible on the video monitor.
The pledge of allegiance to the U.S. flag was recited.
The Roll was taken.
Commissioner Morrison offered the following motion: I move that the reading of the minutes for
February 15, 2021 be waived and that the minutes of said meeting, as prepared by staff, be approved as
written.
The motion was seconded by Commissioner Pollard. No corrections were requested.

Commissioner Benberry then joined the meeting.
Planning Commission Continued Cases
Case #: PLT2020-101
Case PLT2020-101 was left on the table awaiting roadway and stormwater agreements between the
developers and the City Engineer’s office.

Case #: TXT2021-029
Text amendment to Section 126-87 Mobile Food Vehicles.
Commissioner Wade offered:

I move that this Commission adopt a resolution recommending to the Board of Commissioners that case
TXT2021-029 pertaining to the text amendment of Section 126-87 Mobile Food Vehicles of the Paducah
Zoning Ordinance be adopted.
Commissioner Pollard seconded.
Senior Planner Josh Sommer explained exemptions for mobile food vehicles was proposed to be
clarified when a mobile food vehicle was operating in a stand-along fashion, as in a mobile food court
or when covered by a Special Event permit from the Parks Department. He further stated the
Purchase District Health Department and Fire Prevention Departments should be made by reference
in order to keep from updating the zoning ordinance every time their regulations change. Mr.
Sommer stated there were not enough 220 electrical outlets to accommodate mobile food vehicles
on Broadway and lack of infrastructure was the reason behind requesting mobile food vehicles on
Broadway with generators.
Vice-Chair Schramke asked if residential meant second story as well. Mr. Sommer stated it did.
Commissioner Morrison asked if no generators were allowed on Broadway as adopted in 2017 was
because the generators would be loud. Mr. Sommer stated that was correct. Commissioner
Morrison further asked if the ordinance could be changed back. Mr. Sommer stated it could as a
request from the Planning Commission.
Commissioner Pollard clarified that a mobile food vehicle with a generator could not be within 100
feet of a residence. Mr. Sommer stated that was correct. Vice-Chair Schramke asked if a truck
without a generator could park on Second Street or Broadway. Mr. Sommer stated they could. Vice-
Chair Schramke stated she was uncomfortable with moving forward with this section of the
proposed text amendment. Mr. Sommer asked if the exemption text amendment could move
forward.
Further discussion was made regarding mobile food vehicles on Broadway pertaining to specific
locations and code enforcement.
Vice-Chair Schramke offered:
An amendment to the motion on the floor to only consider Subsection C at this point.
Commissioner Benberry seconded.
No further questions were asked. Chairwoman Crecelius called for the vote.

Text amendment to Section 126-115 Historical Zones, H-1 and H-2.

I move that this Commission adopt a resolution recommending to the Board of Commissioners that case
TXT2021-030 pertaining to the text amendment of Section 126-115 Historical zones, H-1 and H-2 of the
Paducah Zoning Ordinance be adopted.
Commissioner Morrison seconded.
Mr. Sommer explained the proposed text amendments for screening, multi-family dwellings, stand-
alone findings for historical integrity and informal meetings before the HARC.
No questions were asked. Chairwoman Crecelius called for the vote.

Case #: USE2021-032 2011 South 28th Street
Conditional Use recommendation to the Board of Adjustment for a home occupation.
Commissioner Pollard offered:
I move that this Commission recommend to the Board of Adjustment case USE2021-032 pertaining to
2011 South 28th Street for a conditional use be approved.
Vice-Chair Schramke seconded.
Mr. Sommer explained the parameters in which the Petitioner would like to conduct a home
occupation to be a personal trainer. These include a maximum of 12 people a day, no more than two
people training at time, a 15 minute gap between clients to keep the driveway clear and hours of
operation to be between 7 a.m. to 9 p.m.
Chairwoman Crecelius asked how close the neighbors and how much noise would be created. Mr.
Davis stated he mostly does weight lifting. Mr. Davis showed video of the neighboring properties.
He further stated he would play music but it couldn’t be heard when the door is shut.
Vice-Chair Schramke asked if the garage was insulated. Mr. Davis stated he would use space heaters
in the winter and he would start insulating the garage. Mr. Davis stated he planned to utilize shop
fans in the summer.
Commissioner Morrison asked if parking was allowed along the street. Mr. Davis stated it was not
allowed but the driveway could fit six cars. Commissioner Morrison further asked if he owned the
home. Mr. Davis said he does have a mortgage on the home.
Vice-Chair Schramke stated she had concerns with the client’s health. Mr. Davis stated the Fire
Prevention Department had visited the property and did not require any building modifications.
Chairwoman Crecelius reiterated concerns about noise from the shop fans. Mr. Davis stated he did
intent to stay within the Noise Ordinance and he had spoken to the neighbors, who reportedly, did
not have concerns.
No further questions were asked. Chairwoman Crecelius called for the vote.

Adjournment
Chairwoman Crecelius asked if there was any other business to be brought before the Planning
Commission, seeing none she adjourned the hearing at 6:06 pm.
