A RESOLUTION AMENDING A RESOLUTION ENTITLED: "A RESOLUTION
SETTING OUT THE NEED FOR THE CREATION OF AN AGENCY FOR THE EXERCISE
OF SUCH POWERS, FUNCTIONS, AND DUTIES GRANTED BY CHAPTER 99 OF THE
KENTUCKY REVISED STATUTES AND AUTHORIZING THE CREATION OF SUCH
AGENCY"
WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky
adopted the above entitled resolution on the 23rd day of February, 1960, and
WHEREAS, pursuant to such resolution the Urban Renewal and
Community Development Agency of the City of Paducah, Kentucky was duly created
in accordance with Kentucky Revised Statutes 99.350, which agency was granted the
powers, functions and duties prescribed by such statute, and
WHEREAS, said Agency has, since its inception, performed its duties
and responsibilities in accordance therewith, and
WHEREAS, the United States has now enacted a statute, known as the
"Housing and Community Development Act of 1974" (P. L. 93-383, et seq., 88 Stat.
633 et seq. , 42 USCS, Sec. 5301 to 5317), which prescribes broader action and
implementation by the municipality respecting the grant, loan and use of federal
funding, which includes a portion of the duties, functions and powers of said Agency,
but also includes certain provisions outside the jurisdiction and authority of said
Agency and requires that said municipality shall be responsible for use of such funds
within the authority of said Act, and
WHEREAS, municipality deems that it is necessary and desirable, and in
the public interest and for the public benefit and welfare that certain amendments be
made, which will retain the powers of said agency as hereafter limited, and which will
provide municipality the jurisdiction and authority, pursuant to such U. S. Statute, to
comply with and perform all powers, functions and duties required thereby to fully
and completely parti,�ipnte in the funding permitted by such statute; and
WHEREAS, said municipality finds and determines that it would be more
efficient and in the public interest for certain of the powers, functions and duties of said
Agency he exercised by eaid munieipality, and
WHEREAS, such Agency is authorized to delegrete to municipality any of
its powers or functions as s_t forth in Kentucky Revised Stahrtor, 99,560,

SECTION 1. The resolution heretofore adopted respecting creation of the
rban Renewal and Community Development Agency is hereby amended by limiting the
Owers, functions and duties of said agency, as granted in said resolution, except to
ie extent of those powers, functions and duties, which shall be retained by said agency
ursuant to a contract between Agency and Municipality, such contract being authorized
V Kentucky Revised Statutes 99.560.
SECTION 2. Such contract shall set forth provisions respecting actions
be taken, powers, functions and duties to be delegated, or limited, between the
Urban Renewal and Community Development Agency and the City of Paducah, Kentucky
as may be deemed necessary and desirable and in the public interest, as determined
by said city.
SECTION 3. It is further found and determined that such contract is
necessary for the efficient and orderly implementation of a comprehensive community
development plan consistent with the Federal Housing and Community Development Act,
and the rules and regulations of the Department of Housing and Urban Development as
they may exist from time to time.
SECTION 4. The City Manager and Corporation Counsel are authorized and
directed to prepare a contract as set forth for approval by the Commission. The Mayor is
hereby authorized to execute such contract on behalf of the Municipality.
SECTION 5. This resolution shall be in full force and effect from and
after its adoption.
