ORDINANCE NO. 73-2-766
AN ORDINANCE AUTHORIZING THE SALE AND CONVEYANCE BY THE CITY
OF PADUCAH, KENTUCKY, TO SALVATION ARMY OF PADUCAH, OF LOTS NOS. 8, 9,
10, 11, 12, 13 AND 14 IN BLOCK NO. 3 OF THE J. N. BAILEY ADDITION,
AND PRESCRIBING THE TERMS AND CONDITIONS UPON WHICH SAID SALE AND
CONVEYANCE MAY BE MADE
WHEREAS, the City of Paducah, Kentucky, is the owner of Lots
Mos. 8, 9, 10, 11, 12, 13, and 14 in Block No. 3 of the J. N. Bailey
Addition in said City, and
WHEREAS, Salvation Army of Paducah, a Georgia Corporation, is
desirous of acquiring said property for social and recreational
purposes and has offered to pay to said City the sum of $3,750.00
for same, and
WHEREAS, the City of Paducah, Kentucky, is willing to accept
said offer to sell said property to said Salvation Army of Paducah
for such purposes at any time on or before December 31, 1974.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah, Kentucky, accept the
offer of Salvation Army of Paducah, a Georgia Corporation, of 729
south 21st Street, to purchase for $3,750.00 and subject to the
following terms and conditions, the following described land in said
City:
Being Lots Nos 8, 9, 10, 11, 12, 13 and 14 in Block
No. 3 of the J. N. Bailey Addition to the City of
Paducah, Kentucky, as shown by plat recorded in Plat
Book "A", page 234 in the office of the Clerk of the
McCracken County Court. Each lot fronts 48 feet on South
22nd Street and extends back uniformally a distance of 160
feet.
Being a part of the same property that was conveyed to the
City of Paducah, Kentucky by deed dated Septamber 30, 1963,
and recorded in Deed Book 453, page 125, in the McCracken
County Court Clerk's office.
SECTION 2. The terms and conditions of such sale are that i
on or before December 31, 1974, the said Salvation Army of Paducah
pay to the Treasurer of said City the sum of $3,750.00, and furnish
to the City Manager of said City for his approval an executed ,
contract, executed by said Salvation Army of Paducah, for the II
construction upon said property of a building or buildings to be
used for social and recreational purposes by the citizens of the
City of Paducah. If such conditions are not complied with by such
time, this ordinance shall be null and void and of no effect whatsoever.
SECTION 3. Upon the compliance by Salvation Arm4 of Paducah
of the requirements set forth in Section 2 hereof, the Mayor and
City Clerk are hereby authorized and directed to convey, on behalf of the
City, to said Salvation Army of Paducah, the property described in
Section 1 hereof, and said deed of conveyance shall contain no warranty
as to title and shall be subject to any state of facts that might be
shown by an accurate survey.
SECTION 4. This ordinance shall be in full force and effect
from and after its adoption.
