ORDINANCE NO. 74-10-1035
AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY PROVIDING FOR THE HOLDING OF AN ELECTION ON THE
QUESTION OF WHETHER AN ANNUAL SPECIAL SCHOOL BUILDING TAX RATE OF
FROM FIVE CENTS TO THIRTEEN CENTS SHOULD BE LEVIED FOR A PERIOD OF NOT
EXCEEDING TWENTY YEARS, ON PROPERTY IN THE PADUCAH SCHOOL DISTRICT,
AS REQUESTED BY THE PADUCAH BOARD OF EDUCATION OF SAID DISTRICT, AND
AS PROVIDED FOR IN KRS 160.477
WHEREAS, the Board of Education of the Paducah Independent School District
at its meeting held on September 1.9, 1974, pursuant to KRS 160.477, has requested that
an election be held in the Paducah Independent School District at the regular election
to be held on November 5, 1974, on the question of whether an annual special school
building tax rate of from five cents ($0.05) to thirteen cents ($0.13) shall be levied
for a period of not exceeding twenty (20) years beginning January 1, 1977, on each one
hundred dollars ($100.00) of property subject to local taxation in the Paducah Independent
School District, for the purpose of financing school improvements, school facilities
and school building revenue bonds as set out in KRS 160.477, and
WHEREAS, it is the duty and obligation of the Board of Commissioners
of the City of Paducah, Kentucky, under said statute, upon the written request of the
Board of Education of said school district, to call such election requested by the Board
of Education, and
WHEREAS, the Paducah Independent School District embraces a city of the
second class, and
WHEREAS, the Board of Education of the Paducah Independent School District
has complied with all the requirements of KRS 160.477,
NOW THEREFORE, TILE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY, DOES ORDAIN AS FOLLOWS:
SECTION 1. That there is hereby submitted to the qualified voters of the
Paducah Independent School District the question as to whether or not an annual special
school building tax rate of not less than five cents ($0.05) nor inure than thirteen cents
($0.13) shall be levied for a period of not exceeding twenty (20) Years, beginning
.January 1, 1977, on each one hundred dollars ($1011.00) of property subject to local
taxation in said school district, in addition to the maximum school tax provided by KRS 160.475,;
the ineotr,{. from which annual special school tsix levy shall, if such levy is approved by the
voters, be used for the erection and equipping of new school buildings, for the major
alterations, enlargement and complete equipping of existing buildings, for the purpose of

retiring directly, or through rental payments, school building revenue bonds iss
such school building improvements, and for the purpose of financing any progran
acquisition, improvement or building of schools and to accomplish any or all of sa

j purposes.
SECTION 2. The said election shall be held at the regular election on
November 5, 1974.
SECTION 3. That said election shall be conducted and carried out in s
school district which said school district embraces a city of the second class, in c
respects as required by the general election laws and KRS 100.477, and shall be
by the same officers as required by the general election laws.
SECTION 4. The expense of the election shall be borne by the City of
Paducah, Kentucky.
SECTION 5. In the period prior to the date of said election there shall
in three different issues of the Paducah Sun -Democrat, the last insertion being n4
seven days before the date of said election, and there shall be posted in not less

Notice is hereby given that an election will be held in and for the
Paducah Independent School District on November 5, 1974, at the
regular election held on said date, to determine whether the voters
of said district are in favor of an annual special school building tax
rate of from five cents ($0.05) to thirteen cents ($0.13) on each one
hundred dollars ($100.00) of property subject to local taxation within
the district for a period of not exceeding twenty (20) years, beginning
January 1, 1977, for the purpose of providing for the purchase or Ica:
school sites and buildings, for the erection and complete equipping of
school buildings, for the major alteration, enlargement and complete c
of existing Buildings, for the purpose of retiring, directly or through
rental payments, school revenue bonds issued for such building
irnprovemonts, and for the purpose of financing; any program for the
acquisition, improvement or building of schools: and to accomplish
any and all of said purposes.
This notice is given pursuant to an ordinance ennetecl by thc: hoard
of Commissioners of the City of Paducah, Kentucky, on October 15,
1974, to which reference is hereby made for further details.

SECTION 6. The City Clerk of the City of Paducah is hereby authorized
and directed to advertise said notice of said school tax election in accordance with the
provisions of this ordinance.
SECTION 7. That the question to be submitted to the voters of said school
district shall be in substantially the following form:
"Are you for or against a levy each year of a special school
building tax rate of not less than five cents ($0.05) nor more than
thirteen cents ($0.13) on each $100.00 of property subject to local
taxation in the Paducah Independent School District for twenty (20)
years, beginning January 1, 1977?
That after said question there shall be written the words "FOR" and
"AGAINST". and appropriate provision shall be made in order that each voter may
indicate his preference.
SECTION 8. If a majority of those voting on the question favor the annual
special school building tax levy, the Board of Commissioners of the City shall, when
the annual tax rate for the school district is fixed, levy the special rate specified by the
Board of Education for the school district for the school building fund, in addition to
the levy provided for by KRS 160.475.
SECTION 9. In addition to or in lieu of the special tax, if approved as herein
provided, the Board of Education of the district may pay into the special fund, at the
close of any fiscal year, the proceeds from the sale of land or property no longer needed
for school purposes, and also any balance remaining in the general fund over and
above the amount necessary for discharging obligations for the fiscal year in full.
SECTION 10. The special fund herein provided shall be kept in a separate
II; account designated as "Paducah Independent School District Special Voted School
Building Fund". This fund shall be kept in a depository selected by the Board of
Education of said school district or invested in such manner as provided by law.
SECTION 11. All expenditures from said fund shall be made solely for the
purposes as set out In YRS 160.477 and shall be made in accordance with the school
laws of the state, at such time as the Board of Education of the Paducah Independent
School District shall determine,. Said Roard shall cause to be made annually an audit
of the building fund by a Certified Publie Accountont or by an accountant approved
by the State Department of Education.
