ORDINANCE NO. 74-10-1034
AN ORDINANCE AMENDING SUB -SECTION (b) "EXEMPTION FROM HOUSING
PROVISIONS" OF SECTION 101-7 "UNLAWFUL HOUSING PRACTICE", OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
WHEREAS, the City of Paducah, Kentucky, has as it's policy the safe-
guarding of all individuals within the city from discrimination because of race, color,
religion, sex or national origin, and
WHEREAS, the City of Paducah, Kentucky, on March 9, 1971 adopted an
ordinance which banned discriminatory practices within the City of Paducah, Kentucky,
and
WHEREAS, the Department of Housing and Urban Development and the
Kentucky Commission on human Rights have recommended various amendments to the
Paducah anti -discrimination ordinance in order to adhere to recent changes in the
statutory law of the Commonwealth of Kentucky.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Sub -section (b) "Exemption from housing provisions", of
Section 101-7 "Unlawful housing practice", of the Code of Ordinances of the City of
Paducah, Kentucky, is hereby amended to read as follows:
"(b) Exemption from housing provisions.
(1) Nothing in this section shall apply:
(a) To the rental of a housing accommodation in a
building which contains housing accommodations
for not more than two (2) families living independently
of each other, if the owner or member of his family resides
in one of the housing accommodations:
(b) To the rental of one room or one rooming unit in a
(a portion of a) housing accommodation by an individual
(the occupant of the housing accommodation or by the
owner of the housing accommodation) if he or a member
of his family resides therein:
(c) To a religious institution, or to an organization operated
for charitable or educational purposes, which is operated,
supervised or controlled by a religious corporation,
association or society to the extent that the religious

corporation, association or society, limits or gives
preference in, the sale, lease, rental, assignment
or sub -lease or real property to individuals of the same
religion, or makes a selection of buyers, tenants, lessees,
assignees, or sublessees, that is calculated by such
religious corporation, association or society to promote
the religious principles for which it is established or
maintained;
(2) Nothing in this chapter shall be construed to affect the legal
rights of a private individual homeowner to dispose of his property through
private sale without the aid of any real estate operator, broker or salesman,
and without advertising or public display;
(3) Nothing in this section shall require a real estate operator to
negotiate with any individual who has not shown evidence of financial ability
to consummate the purchase or rental of a housing accommodation."
SECTION 2. Section 1 above amends a portion of sub -section 7 of Ordinance
No. 71-3-441 which was adopted by the Board of Commissioners of the City of Paducah,
Kentucky, on March 9, 1971.
SECTION 3. If any parts of this ordinance are for any reason held to be
invalid, such decision shall not affect the validity of the remaining portions of this
ordinance. The Board of Commissioners of the City of Paducah, Kentucky, hereby
declares that it would have passed this ordinance, or each part or parts thereof,
irrespective of the fact that any one part or parts be declared invalid.
SECTION 4. This ordinance shall be introduced and remain on file for public
inspection for at least one week in the completed form in which it shall be put upon its
final passage, and if adopted shall be in full force and effect ten days thereafter.
